               Why our school song remains unchanged
        ―“Japan is a Nation of God with an Emperor at the Center”

  This column is newly designed to invite English speaking readers to join
the discussion regarding “Japan is a Nation of God with an Emperor at the Center” (Yoshiro Mori, former prime minister, 2000) and the school slogan “Aim for The No.1 Senior High School in the Nation of God” (the 100th Commemorative Edition, 2001) by Hikawa Senior High School in Yamanashi Prefecture, Japan.

   To re-cap, the New Japanese Constitution explicitly created a separation between the rule of law in Japan and the role of the Emperor in Japanese society. After World War Japan started moving to a democratic model of government, while limiting the authority of the Emperor. He was positioned as a symbol of Japan, and imperial rescripts issued by Emperor Meiji such as the Imperial Rescript to Soldiers and Sailors (1882) and the Imperial Rescript on Education (1890), and the like were all annulled and abolished by the New Japanese Constitution (1947).

   Despite this fundamental change, one public high school in Yamanashi, Hikawa Senior High School, has promoted the old system through their school song, the same one sung during the War, imposing “Rescripts of Emperors” on the students. The school song reads, “With rescripts of emperors, Now is the time to achieve feats”. Regrettably the school administration, the teachers and the students do not seem to feel it inappropriate to be singing such a song under the New Japanese Constitution (the Revised Meiji Constitution).

Since 1985, under the leadership of the 23rd school master, Masaaki Yamamoto, we have tried to urge the people concerned to start discussions over this unconstitutional and anachronistic school song and replace it with a new one in compliance with the spirit of the New Constitution. But unfortunately they have had no ears to listen. The matter was finally brought to the Tokyo High Court, which stressed the need foradequate discussionon this topic on May 17, 2006.

It is questionable whether the school song conforms to principles of the Japanese Constitution based on the people’s sovereignty and the system of symbolic emperors.
Regarding the relevance of taking such a school song that includes the aforementioned phrase into the curriculum, adequate discussion is required.

    Still, to this day, school officials remain silent even on this ruling.                        なぜ母校校歌は残されたのか
                                                                     ―「日本は天皇を中心とする神の国」―

このコラムは英語圏の読者に対し、「日本は天皇を中心とする神の国」(森喜朗元首相、 2000年)や「神州第一の高校」(『創立百周年記念誌』2001年)を宣言した山梨県立日川高等学校をめぐる討論への参加を要請するために新たに計画されました。

 要点は、第二次世界大戦後新憲法が発布され、日本社会における法の支配と天皇の役割とがはっきりと分離されたというところにあります。戦後の日本は民主的な政体へと動き出し、天皇の権威は制限されて「日本国の象徴」の位置に置かれることになりました。そして、明治天皇によって発布された「陸海軍軍人に下し賜はりたる勅諭(軍人勅諭)」(1882年)や「教育勅語」(1890年)などすべての「天皇の勅」は、新憲法(1947年)によって排除・失効となりました。

このような根本的な変化があったにもかかわらず、山梨県内の公立高校である日川高校は、生徒たちに戦中と同じ校歌を歌わせることにより旧体制を推し進め、「天皇の勅」を現在の生徒に押しつけてきました。校歌では、「天皇の勅もち 勲立てむ時ぞ今」と歌われていますが、残念なことに、新日本国憲法(改正明治憲法)下にある公立高校で、このような校歌を歌うことを不適切だと感じる学校関係者、教師、生徒たちはいないようです。

 1985年以来私たちは、山本昌昭第23代校長の指導の下に、日川高校の関係者に対しさまざまな機会を通じて校歌が違憲であり時代錯誤であると指摘し、議論をするよう訴えてきました。そして、校歌を新憲法下の理念に沿うものに改定するよう訴えてきました。しかし残念なことに、彼らは全く聞く耳を持ちませんでした。この問題は最終的に東京高裁に持ち込まれましたが、「十分な議論が必要である」とする高裁判決に対しても口を閉ざしたまま今日に至っています。2006517日、東京高裁は次のような判決を下しました。

Regarding the Korea Times editorial titled “Japan slips into retrograde”, which was reprinted in The Japan Times on Aug. 31: As a Japanese person who is a member of the Society for the Annulment of Imperial Rescripts, I want the Japanese people to be courageous enough to confront the past and not be influenced by the voices of those whose minds are still buried in the rubble of war.
   My alma mater, Hikawa Senior High School of Yamanashi Prefecture, was established in 1901, yet the students continue to sing a school song that played a crucial role in sending students into battlefields. The song says, “With rescripts of emperors, Now is the time to achieve feats”.
   As all Imperial Rescripts have been made null and void since the end of World War under Article 98 of the Japanese Constitution, we think it is improper for school masters and others concerned to force today’s students to sing this unconstitutional school song.
   In 2004, 17 Yamanashi residents, including myself, filed a lawsuit with Kofu District Court, and in 2006, the Tokyo High Court ruled tentatively that it is questionable whether the school song conforms to principles of the Japanese Constitution based on the people’s sovereignty and the system of symbolic emperors.
   We have been fighting this bellicose school song in many ways for many years, but the situation has not changed. The people in charge have no ears to listen to our questions or the Tokyo High Court ruling. What shall we do, then, to prevent Japan from being perceived historically as “the Galapagos Islands”?

 831日付のジャパン・タイムズ紙に転載されたコリア・タイムズの論説、「退化する日本」に関連して、私は「天皇の勅失効確認を求める会」のメンバーとして同胞たちにこう訴えたい。「みなさん、戦争を美化する人々の声に惑わされることなく、過去と向き合う勇気を持ちましょう」と。
 私の母校である山梨県立日川高校は1901年の創立であるが、学校は戦時中に生徒たちを戦場に送り出すのに決定的な役割を果たした校歌を現在の生徒にも歌わせている。歌詞には、「天皇の勅もち 勲立てむ時ぞ今(すめらみことのみこともち いさおしたてむときぞいま)」と書かれている。
 第二次世界大戦後すべての「天皇の勅」は日本国憲法第98条によって失効・排除となっていることから、私たちは校長や学校関係者が憲法違反の校歌を現在の生徒に歌わせることは適切ではないと考えている。
  2004年、私を含む17人の原告は甲府地方裁判所に提訴し、2006年に東京高裁は、「日川高校の校歌の歌詞が国民主権、象徴天皇制を原理とする日本国憲法の精神に沿うものであるかについては異論がありうる」との判決を下した。
 私たちはこの好戦的な校歌と長い間さまざまな方法を通して闘い続けてきたが、状況に何らの変化もみられない。この公立高校の運営に責任ある人々は、われわれの質問にも東京高裁の判決にも真摯に向き合う姿勢をみせてはいない。このような状況下で、この日本が歴史認識上の“ガラパゴス諸島”と呼ばれるのを防ぐために、われわれは今後何をすべきなのだろうか。

What did Japan learn from history?

Let me start with a hypothesis. What would happen if the political leaders and the people in Germany were still singing the Nazi Party song in public and showing ardent reverence for Hakenkreuz (the Swastika)? What if the general public and the government officials in Italy were still cheering the political creed of Benito Mussolini? No doubt the people in the world would shudder with terror and lose no time in voicing serious concerns. Luckily, the world has been rid of these fearful leaders. Near the end of the War, Hitler (1889~1945) killed himself and Mussolini (1883~1945) was slain by his partisans.

 During that devilish War, Japan was considered “a rogue nation” together with Germany and Italy. However, the people of Germany were somehow able to see a stream of light toward the future. Politicians in Germany have expressed deep regret and apologized for the atrocities committed by their predecessors. One example is the case of former West German Chancellor Willy Brandt who fell to his knees in front of a memorial to the victims of the 1943 Warsaw Ghetto Uprising (The Japan Times, Feb.25, 2014). Another is a famous address given in the parliament in West Germany on May 8, 1985 by then-West German President Weizsacker, who is reported to have said, “Anyone who closes his eyes to the past is blind to the present”.

In contrast, many people in the world must be wondering why the Japanese war leader Emperor Showa was exempted from the Tokyo War Crimes Trials. According to the Washington Post (Gallup poll) published on June 29, 1945, 70 percent of Americans had the opinion that the Emperor was guilty, of whom 33 percent said that he deserved execution . However, not only was the former Living God exempted from any war responsibility, but the then symbols of aggression, Kimigayo (the national song) and Hinomaru (the national flag) of Japan were preserved and even today these two relics are sung and hoisted at ceremonies in every public school in Japan.

 In the end, under the protection of General MacArthur and the U.S. Government, the leader of “the former rogue nationwas able to die a peaceful death at age 87 in 1989. Unfortunately I never heard a word of apology delivered from his mouth. As a Japanese descendant I wanted him to say one simple phrase, “I’m sorry.” If he had done so and taken the necessary, appropriate measures like those leaders in Germany, I would have viewed him with positive eyes as a Japanese citizen and a human being.

Ending the Pacific War on Aug.14, 1945, Emperor Showa issued a rescript titled The Imperial Rescript of the Terminationof War in which he ordered his subjects to believe in the “immortality of the Nation of God”. Having heard this Rescript, his loyal subjects must have secretly determined to make the utmost effort to rebuild the nation exactly as it used to be. The following year, on January 1, 1946, Emperor Showa issued another rescript decreeing that the idea of calling him “Living God” was nothing but a myth, but it seems that loyal subjects believed that the former revelation was of his true heart and that the latter was tampered with by the former enemy. Rebuilding the “Nation of God with an Emperor at the Center” has since been kept as the untold objective for his loyal subjects to accomplish in the process of post-war history.  

In the minds of loyal subjects, there seems to have been a deep-seated, ambivalent feeling toward the United States, the former enemy that sent the holy nation into hell. In such a psychological context, the phrase “Japan is a Nation of God with an Emperor at the Center” was unearthed afresh by Prime Minister, Yoshiro Mori, in 2000. It was initially accepted as a slight surprise by the Japanese people, but at the same time this remark acted as a catalyst for a large portion of the Japanese people to start reconsidering the constitutional framework of Japan. “In which is happier to live, a nation of an Emperor or a nation without? ”

As time passed, some people started to surmise that “A nation of God with an Emperor at the Center” appears happier and more appropriate than the nation of freedom and democracy imposed by the United States. People may have become unsatisfied with those western ideologies that have proved less fulfilling than initially expected. In 2001, bolstered by Mr. Mori’s remark, my almamater, Hikawa Senior High School (which already had included the phrase “Rescripts of Emperors” in the school song) proudly made public the slogan “Aim for the No.1 Senior High School in the Nation of God” for the benefit of the students and the members of the alumni association.

More recently, since the re-appearance of Prime Minister Shinzo Abe in 2013, the Japanese conservative politicians and public servants have been questioning the idea of the Peace Constitution. In particular, voices from right-wingers have become harsher than ever before and demanding what they perceive as a historical perception of masochism be wiped out of this country. These ethno-centric moves which also have long been occupying the hearts of the Japanese population have a lot to do with the idea of “The Nation of God with an Emperor at the Center”. Together with Abe’s hawkish remarks, these moves appear to be accepted without major objections.  

On Feb.13, 2014, an eye-catching newspaper column as shown below appeared on International New York Times, which implied psychological ties among the right-wing terrorist organization Sekihotai, Prime Minister Abe and the Imperial House of Japan. Readers of the column with the headline, “Japan’s right-wing stirrings” will see the inseparable link between the “Nation of God with an Emperor at the Center” and the moves of the terrorist group.

On May 3rd 1987, a man with a shotgun stormed into the Hanshin Branch Office of the Asahi Newspaper and shot a 29-year-old reporter to death. This is recorded as a case committed by “Sekihotai” (Wikipedia), but remains unsolved to this date. In addition, the group occasionally threatens not only “left-leaning” Japanese celebrities but conservative politicians like ex-Prime Minister Yasuhiro Nakasone and Noboru Takeshita, urging them to pay visits to Yasukuni Shrine. This means that the moves of this right-wing terrorist group cannot be separated from the idea of Yasukuni Shrine and traditional Japanese Shintoism. One of the cases that shows the link between right-wing terrorists and Shintoism is the well-known murder case of Education Minister Arinori Mori committed by a man belonging to nationalistic Shintoism in 1889. It is not too much to say that Japan in modern history has been monitored closely by right-wingers that safeguard the Imperial System of Japan.

The writer Norihiro Kato, a renowned literary scholar and a professor at Waseda University (as of March, 2014) wrote the following in the  International New York Times.

One night in 1989, I got a phone call at home from someone who claimed to belong to the right-wing terrorist organization Sekihotai, the Blood Revenge Corps. In the previous weeks, I had published two opinion articles criticizing the recently deceased Emperor Hirohito, emphasizing his responsibility for World War and questioning the deference he was being shown by the press and the population.  (International New York Times. Feb.13, 2014)

This sort of violent right-wing discourse that characterized Sekihotai is now all too familiar. Just look at visitors’ comments on Mr. Abe‘s Facebook page.Forget about those primitive Chinese and Koreans. The time has come to do battle with the anti-Japanese mass media (above all Asahi types),says one, adding,The primitive Chinese and Koreans have no influence anyway; The Japanese mass media, which go on brainwashing so many of the nation’s citizens, are infinitely worse. They’re a dauntless hardy enemy, but this is a fight-or-die moment. Fight for us, Prime Minister Abe!!”  (International New York Times. Feb.13, 2014)

 What Prof. Kato tried to make clear is the nexus between the Great East Asia War and the war responsibility of Emperor Showa. For right wingers, this sort of idea, however, is regarded as unpardonable blasphemy to the Emperor. It seems the voices and the actions of right-wingers will keep gaining momentum when the conservative politician, Abe gains further political power economically and diplomatically. Prof. Kato also laments the response of the weak-kneed Japanese media and the inaction of the Japanese police force against Sekihotai.

 The weeks of terror my family endured were a purely private affair: The police hardly did anything, and the newspaper that had printed my article made clear that it did not wish to get involved.(International New York Times. Feb.13, 2014)

 On December 16, 2013, Prime Minister Abe who is also a member of the same political party with Mr. Mori (Liberal Democratic Party) visited Yasukuni Shrine despite a “warning” from Japan’s ally, the United States. This has caused people in the world to raise their eyebrows at a potential sign of the resurgence of the die-hard militarism of Imperial Japan. Actually Japan is moving from defense only policy to that of a “normal nation” which would be capable of fighting any country anytime when necessary under the name of “self-defense”. In addition, for the right the meaning of a “normal nation” is not onlyindependentfrom the United States, but also it has to be “A Nation of God with an Emperor at the Center”.

The people in the world will be sure to raise questions, “To where is Japan going?”, “Does Japan have a compass to take it somewhere?” These political conundrums concerning Japan remind me of the so called, “Cap in the Bottle Theory”— In March 1990, Maj. Gen. Henry C. Stackpole, commander of Marine Corps bases in Japan stated the following:

“We are the cap in the bottle” (Maj. Gen. Henry C. Stackpole)

“No one wants a rearmed, resurgent Japan……so we are the cap in the bottle, if you will…..If we were to pull out of the U.S.-Japan Security Treaty, it would definitely be a destabilizing factor in Asia.” (Commander of Marine Corps bases in Japan. March 1990)

This indicates that the U.S. Commander is admitting that the relationship between the United States and Japan has not been built on a mutual trust for decades. He didn’t elaborate the reason of his distrust, but another opinion poll conducted in the United States in 1999 shows the seriousness of the problem that lies between the two countries. Asked about the purpose of the U.S. Japan Security Treaty, 49 % of the respondents cited the “prevention of the military expansion of Japan” as the reason, and only 12 % cited the “defense of Japan”.

Why are so many Americans fearful of a Japanese military expansion? Japan is said to be a peace-loving nation mainly due to the “Renunciation of War” clause in Article 9 of the Japanese Constitution. However, the majority of the Japanese people have not been informed of the backstory of the formation of this clause. Rather than the generally accepted notion that the clause was forced on Japan by the United Stated, it was Japan itself that voluntarily arranged this “bottle” to jump into. It was the Japanese side that proposed to confine itself inthe bottle”. (About the proposer, Toshio Shiratori, ex-Italian ambassador and a Class-A war criminal, I am going to write about him next time.)

The rationale of the clause of “Renunciation of War” is quite simple. Loyal subjects wanted the United States, the former enemy to exonerate and safeguard the Emperor from any war crimes. This idea coincided with the U.S. strategy that set Japan as a bulwark against communism. Few will not deny the possibility that Emperor Showa himself played an active role in arrangingthe bottle”. The Emperor must have thought that many decades would be required before the war-victims softened their pains and the memories of being invaded and occupied. As a matter of fact, Emperor Showa himself suggested to the United States to occupy Okinawa “for more than 25 years, 50 years, or more”.

Japanese politicians have often been criticized as weather vanes. They are not accustomed to taking responsibility in critical times. As of April 2014, the 69th year since the end of the War, the United States, seriously “disappointed” by Prime Minister Abe’s visit to Yasukuni Shrine, fully needs to reconfirm the significance of “Cap in the Bottle Theory” and watch closely and control the route of the disoriented Japanese ship. As long as Japan is in step with the United States, the neighboring countries can take sighs of relief, because they can read the path Japan will take. But if Japan that has been behind the United States for almost 70 years reappears in the front, the countries around Japan will be sure to get nervous. They still vividly remember the enigmatic strategies of the “Nation of God with an Emperor at the Center”.

At the same time, if the Japanese people truly hope to live in a democratically matured nation”, they must belatedly have the courage to look back and face the sorrowful past head-on. They also have to admit that it is a grave miscalculation to expect that someday, somehow, the victims of the War and the descendants might forget the terrible things done to them. Such a “future-oriented relationship” which is often advocated by Mr. Abe and his colleagues cannot be achieved without sharing the past as shown by the politicians in Germany. To break this diplomatic deadlock, the Japanese people should start talking about the responsibilities of Emperor Showa before and during the war and reconsidering the role of the national anthem and the national flag in Japan, in particular the school song of Hikawa Senior High School that singsWith Rescripts of Emperors, Now is the Time to Achieve Feat.”

まずは、仮定の話から始めよう。もしもドイツの政治的指導者や人民が今もナチ党歌を歌い旧ナチ紋章であるカギ十字に対し深い敬意を示していたら、一体何が起こるだろうか。もしもイタリアの一般大衆や政府官僚がベニート・ムッソリーニの政治綱領を称えているとしたら、どうなるのだろう。疑いもなく世界中の人々は恐怖に怯え、深い懸念の声をあげるだろう。幸運なことに、世界はこれらのおぞましい指導者を排除してきた。大戦末期にヒトラー(18891945)は自殺し、ムッソリーニ(18831945)は自国の遊撃兵によって殺された。

あの悪夢のような戦時において、日本はドイツ・イタリアとともに「ならず者国家」とみなされていた。しかしながら、ドイツの人民は、未来に向けて一条の光明をとらえることができた。ドイツの指導者の中には前任者たちが犯した残虐行為を謝罪し、深い慙愧の念を表明する政治指導者がいたのである。一例を挙げれば、西ドイツのウィリー・ブラント首相がいる。彼は1943年に起きたワルシャワ収容所蜂起の犠牲者の記念碑の前にひざまずいている(『ジャパン・タイムズ』225 2014)。もう一人は、198558日、当時のヴァイツゼッカー西ドイツ大統領である。彼は歴史に残る有名な議会演説の中で、「過去に目を閉ざす者は現在にも盲目となる」と語ったと報じられている。

これとは対照的に、世界の多くの人々は、日本の戦争指導者である昭和天皇が東京戦犯法廷で免罪となった理由についていぶかしく思っているにちがいない。1945629日発行のワシントンポスト紙(ギャラップ世論調査)によると、約70パーセントのアメリカ人は昭和天皇が有罪であると考え、そのうち33パーセントは処刑が妥当であると述べている。① しかし“元生き神様”は戦争責任を免れたばかりでなく、当時侵略のシンボルであった「君が代」(国歌)と「日の丸」(国旗)は残され、今もこれら二つの遺物は日本中の公立学校で掲揚され、また歌われている。

結局、マッカーサー元帥とアメリカ政府の保護の下に、「旧ならず者国家」の指導者は、198987歳で平和な最期を迎えている。残念ながら私は、彼の口から一言の謝罪の言葉を聞くことはなかった。日本人の子孫として、私は彼の口から「申し訳なかった」という一つの単純な言葉を言ってほしかったのだ。もし彼がその言葉を口にし、ドイツの指導者たちのように、必要かつ適切な措置を講じていたら、私は日本人として、また一人の人間として、彼を肯定的な目で見ていただろう。

太平洋戦争は1945814日に終わり、昭和天皇は「戦争終結の詔勅」を出した。その中で彼は、臣民に“神州不滅”を信じるよう促している。この詔勅を聞いた彼の忠実なる臣下たちは、あらゆる努力を傾注して、昔そのままの国家再建を秘かに誓ったにちがいない。翌年の194611日、昭和天皇は新たな詔勅を出し、彼を「生き神様」と呼ぶのは神話に過ぎないとの旨を述べた。しかし、忠実な臣下たちは、前の詔勅が天皇の本心であり、この詔勅は旧敵国によって改ざんされたものであるとみなしたのだ。“天皇を中心とする神の国”の再建は、忠実なる臣下にとってそれ以来、戦後史の過程で達成すべき暗黙の目標となった。

忠実な臣下の心には、神国を地獄に送り込んだ旧敵国アメリカに対し、根深い矛盾する感情があるのだろう。そのような心理的脈絡の中で、「日本は天皇を中心とする神の国」なる文言が、2000年に森喜朗首相によって掘り起こされた。その発言は、当初日本国民によってやや唐突な言葉として受け止められたが、その発言は同時に、多くの日本人が現在の日本国憲法の土台を再考するきっかけを与えることにもなった。“天皇を中心とする神の国と天皇のいない国、いったいどちらが幸せなのか”、と。

時の経過とともに、ある人々は考え始めたであろう。“天皇を中心とする神の国”は、アメリカ合衆国によって与えられた自由と民主主義の国より幸福であり、より似つかわしいと。人々は期待されていたほどではなかったそれらの西洋思想に対し、満たされない感情を抱いていたのであろう。2001年、森首相の発言に触発されるかのように、校歌の中に「天皇の勅」をもつ山梨県立日川高校は、生徒と同窓会員に向け、誇らしげに“神州第一の高校を目指せ”とのスローガンを公表した。

最近では、2013年の安倍晋三首相が再登板して以来、日本の保守的政治家や公僕の中に平和憲法の理念に疑義を呈している人々がいる。とくに右派からの声は以前にもまして強くなり、彼らが自虐史観とよぶ考えはこの国から抹殺すべきだとする主張が浮上している。これら自民族中心の日本人の動きは、“天皇を中心とする神の国”のイデオロギーと軌を一にしていると言えるだろう。安倍首相のタカ派発言とともに、これらの動きは大きな反対もなく受け入れられている。
  2014213日、下記のような目を見張る新聞記事が『インターナショナル・ニューヨーク・タイムズ紙』に載った。それは、右派のテロ組織である赤報隊と安倍首相、そして日本の皇室との間の心理的結びつきを暗示するものだった。“日本の右翼の動き活発化”と題するその記事は、読者に“天皇を中心とする神の国”とテロ組織との動きが不可分であることを想起させたであろう。

事実これまでも、198753日、猟銃を持った男が朝日新聞の阪神支局を襲撃し、29歳の記者が射殺されるという事件が起こっている。これは赤報隊による犯行(ウィキペディア)と報じられたが、今日に至るも未解決のままである。その上、同グループは“左寄り”の有名人ばかりでなく、時として、中曽根康弘元首相、竹下登元首相というような保守系政治家まで脅しているのだ。靖国神社へ参拝せよ、と。このことは、右翼テロリスト・グループの動きが靖国神社や伝統的日本神道の考えと密接に関係していることを示している。右翼テロリストと神道との関係を示す事件の一つは、1889年に起った国粋的神道家による森有礼文部大臣刺殺事件である。近代史の中の日本は、皇室を擁護する右翼団体によって監視されていると言っても過言ではないだろう。

作家、著名な文芸評論家、そして早稲田大学教授(20143月現在)でもある加藤典洋氏は、『インターナショナル・ニューヨーク・タイムズ紙』に書いている。

加藤氏が明らかにしようとしたことは、大東亜戦争と昭和天皇の戦争責任の関係である。しかしこの種の論議は、右翼にとって、天皇に対する許されざるべき冒瀆とみなされているのだ。右翼の言動と行動は、安倍首相が経済的にまた外交的に政治力をつよめている今、はずみをつけているように思える。加藤氏は、赤報隊に対する日本のメディアと日本の警察の弱腰ぶりを嘆いている。

20131216日、森元首相と同じ政党(自由民主党)のメンバーである安倍首相は、日本の盟友であるアメリカの“警告”にもかかわらず、靖国神社を参拝した。このことは皇国日本の根深い軍国主義の復活のしるしとして、世界の人々を驚かせた。実際、日本は自衛戦争の名のもとに専守防衛政策を変え、必要なときはいつでも、どの国とでも戦うことのできる防衛力をもつ、“ふつうの国”へと舵を切っている。加えて、彼らにとって“ふつうの国”が意味するものは、アメリカから「独立」しているばかりではなく、“天皇を中心とする神の国”でなければならないのだ。

世界の人々はこう問いかけるにちがいない。「日本はどこに向かって動いているのか。日本は自らの行方を決める羅針盤をもっているのか」、と。日本についてのこれらの難問は、私にいわゆる「ビンのフタ論」を思い起こさせる。19903月、日本駐在のアメリカ海兵隊司令官であるヘンリー・C・スタックポール氏は、こう述べている。

このことは、日米関係が過去数十年にわたり相互信頼の上に築かれているものではないことを、駐日アメリカ海兵隊司令官が認めたものであろう。司令官は不信の理由を明らかにしてはいないが、1999年にアメリカで行われた別の世論調査は、2国間に横たわる問題の深刻さを浮き彫りにしている。日米安保条約の目的について聞かれ、回答者の49パーセントは「日本の軍事大国化防止」をあげ、12パーセントだけが「日本防衛」をあげている。③

なぜそれほど多くのアメリカ人は日本の軍拡を恐れているのだろうか。日本は日本国憲法9条の「戦争放棄」の条項によって恒久平和を願う国民だと言われている。しかしながら、日本人の大部分は、この条項成立の裏話については聞かされていないだろう。その条項がアメリカによって日本に押しつけられたというのが一般な考えであろうが、むしろ自発的に飛び込むためのビンを用意したのは、日本側の発案だったのである。(その発案者である白鳥敏夫(元イタリア大使・A級戦犯)については、次回再度触れるつもりである。)

日本側が提案した「戦争放棄」の理論的根拠はきわめて単純明快である。忠臣たちが唯一旧敵国に望んだことは、天皇を守り、いかなる戦争責任からも免罪となるようアメリカに働きかけることだった。そのアイデアは、日本を共産主義の防波堤にしようとするアメリカの戦略と合致した。“ビン”の用意をするよう天皇自身が積極的な動きをした可能性も排除できないだろう。少なくとも昭和天皇は、戦争の犠牲になった人々がその痛みや占領された記憶を和らげるには何十年も必要だと考えたにちがいない。事実、昭和天皇はアメリカに対し、“沖縄占領は25年、50年、あるいはそれ以上”になるよう提案しているのである。④

日本の政治家はしばしば風見鶏であると批判されてきた。彼らは危機に際して責任をとるということに慣れていない。20144月現在、戦後69年目の今、右派である安倍首相の靖国参拝に“失望”したアメリカは、“ビンのフタ論”の意味を再認識する必要があり、羅針盤のない“日本丸”の方向性をしっかりコントロールすべきだ。日本がアメリカと歩調を合わせているかぎり近隣諸国は安心しているだろう。なぜなら彼らは日本がとる進路を読むことができるからだ。しかし、もし過去70年近くアメリカの背後にいた日本が前面に姿を現すとしたら、日本周辺諸国は必ずや不安になるだろう。彼らは「天皇を中心とする神の国」の不可解な戦略を鮮明に記憶しているからである。

同時に、もし日本国民が“成熟した民主主義の国”に住むことを望むというならば、彼らは遅ればせながら振り返る勇気をもち、正面からあの悲惨な過去に立ち向かわなければならない。彼らが、大東亜戦争の被害者たちやその子孫が、いつの日か、どうにかして、あの戦争の恐ろしい記憶を忘れる日はくると期待しているなら、それはまちがいであることを認めなければならない。安倍首相の属する自由民主党の政治家たちはしばしば“未来志向の関係”を提案する。しかし、ドイツの政治家たちがやったようなやり方で過去を共有することなしには、実現は不可能なのだ。日本国民は、現在の外交的行き詰まりを打開するためにも、戦前・戦中の昭和天皇の責任や日本の国歌・国旗が果たした役割を再考し、とくに「天皇の勅もち 勲立てむ時ぞ今」と歌う山梨県立日川高校の校歌の是非について論議を始めるべきだ。

                                    “The Orientation” I experienced at age 15

Up until March 2014, I was a student of Hikawa Senior High School, a public school in Yamanashi Prefecture. Now I am a college student majoring in psychology. When I entered Hikawa High, I was instilled with “Hikawa Spirit” through Freshman Orientation, which I feel was an attempt to brainwash me. I use the word “brainwash” because most of the freshmen who had initially been intimidated by the senior students later started feeling proud to be a member of the school and became proud of the school song after the Orientation. I myself wasn’t then fully aware of the psychological manipulation I feel the school had practiced on the freshmen.

In the Orientation, held in April (the beginning of the school year), we were expected to memorize the school song even before the Orientation started. If we couldn’t memorize the song well enough, we were bawled out by the senior students. The Orientation was held in the gym with all the black curtains closed. In this gloomy setting we were surrounded and monitored by the senior students who would discipline us in order to transform us into “true Hikawa students”.

What awaited us was a three-day (used to be a week-long) event of unbearable “discipline”. We were ordered to sit on the floor with our legs under ourselves for long periods of time. First came a sense of fear with unbearable pain in our legs. Then, by enduring this ordeal, gradually came a sense of dependence on the seniors who made every effort to change us into men and women of fortitude. And finally came a sense of trust in them. When the Orientation ended, the senior students praised our perseverance, which made many students including some boys shed tears of “gratitude” toward the senior students. Without a doubt, through this program, most of the freshmen must have felt an undeniable feeling of belonging to an organization with a strong sense of comradeship.

There are two reasons I want to say no to this Orientation. One is that I feel this practice is a violation of human rights. Students have the right to be educated without any sort of coercion. The other is the fact that this school song was exactly the same one that forced the Imperial young soldiers to battle in the WWⅡ. In addition, the “Imperial Rescripts of Emperors” sung in this song was made illegal by Article 98 of the new Japanese Constitution in 1947. As long as Hikawa Senior High School keeps singing this school song under the name of tradition, my heart will find no place to rest. In my mind, my alma mater appears to be an educational institution that wanders in “a different dimension” carrying the burden of tradition without considering the consequences.

20143月まで、私は山梨県立日川高校の生徒でした。現在大学1年生で心理学を専攻しています。日川高校に入学した時、私はオリエンテーションを通して“日川魂”を叩き込まれましたが、それは私を“洗脳”しようとしたものだと思っています。私は“洗脳”という言葉を使いました。その理由は、オリエンテーションが始まるころは先輩たちの怒鳴り声に怯えていた新入生たちのほとんどが、それが終了するころには、この学校の一員であることに誇りを持ちはじめ、オリエンテーションの終了後には校歌を誇りと思うようになったということです。私自身、学校が新入生たちのために用意したこのプログラムの心理操作について十分に理解していませんでした。

毎年4月(新学年度の開始月)に予定されているオリエンテーションは、その行事が始まる前から新入生に校歌を正確に覚えておくことを要求していました。もし正確に校歌を歌えなければ、私たちは先輩たちからどなられました。オリエンテーションは体育館で行われ、黒いカーテンはすべて閉じられていました。この暗い体育館の中で私たちは先輩たちに囲まれ監視されていたのです、彼らは新入生を“日川にふさわしい高校生”となるよう鍛えたのです。

私たちを待っていたのは、3日間(以前は1週間)にわたるきつい“鍛錬”の行事でした。新入生たちは板張りの体育館で長時間正座を命じられました。最初は恐怖心と耐えられないほどの脚の痛みに襲われました。それから、この試練に耐えることによって、いつの間にか私たちを質実剛毅な男女に変えるために全力をつくす先輩たちへの信頼心が生れ、最後には先輩への信頼感が芽生えてきました。オリエンテーションが終わったとき、先輩たちは新入生の辛抱を称え、それを聞いた多くの女子学生ばかりでなく男子生徒の中にも、先輩への“感謝”から泣き出す者がいました。この学校行事を通して、新入生たちは明らかに強い仲間意識をもつ組織に所属しているという明確な意識を植えつけられたにちがいありません。

私にはこのオリエンテーションに反対する二つの理由があります。一つは、この行事は人権侵害にあたると感じるからです。新入生たちは強制にさらされることなく教育を受ける権利があると思います。もう一つは、この校歌は第二次大戦中若い皇軍兵士を戦争へ駆り立てたとき歌われたものと同じ校歌であるという事実です。また、校歌の中で歌われる「天皇の勅」は、1947年に実施となった新日本国憲法98条で違法とされました。日川高校が伝統の名のもとにこの校歌を歌い続けるかぎり、私は穏やかな気持ちではいられないでしょう。今の私の目には、私の母校は伝統という重荷を背負いさまよい続ける“異次元”の教育機関のようにみえます。事の重大さが理解されていないのではないでしょうか。

The inside story of the “Nation of God with an Emperor at the Center”– (1) “Renunciation of War”

Considering the relationship between the Nobel Peace Prize andRenunciation of War”

Many people in Japan and in the world may think that theRenunciation of Warclause of the Japanese Constitution was forced unilaterally on Japan by the Occupation Forces and United States. But the following data and analyses will show this is not correct. Many people in the world who have not been informed of the inside story of the formation of the Japanese Constitution are sure to be surprised at the process in which theRenunciation of Warwas created. In human history, self-defense has been interpreted as an inherent right for human beings. In spite of this, post-war Japan explicitly declared the abandonment of such a basic right in the New Constitution, stipulating that Japan will forever renounce war. Why?

On July 10, 2014, I came across an interesting TV program, Super J Channel that starts around 5:00 p.m. The focal point was the relationship between the Emperor and the “Renunciation of War”. A commentator, Prof. Jun Hagitani at Hosei University, made a comment on who should be qualified to go and receive the Nobel Peace Prize in case that the Japanese Constitution which is widely known as the “Peace Constitution” were chosen. Prof. Hagitani unhesitatingly answered by saying that Emperor Akihito (or his proxy) should be sent on behalf of the Japanese people for the reason that he is the symbol of the state.

 How did the general viewers, lawmakers, the Emperor and his family respond to this nation-wide TV broadcast? As the topic lasted only 10 or 15 minutes, many of the viewers, I think, paid little attention to the minute content of the program. Only those who had promoted the idea of “the Nation of God with an Emperor at the Center” might have felt strange over this “out of the blue” idea to use the Emperor, while some others might have felt it irrelevant to use the Emperor for such a secular task. At any rate, Japan is a country in which freedom of speech is guaranteed and any topic is permitted unless it undermines basic human rights and human dignity, so, I see this as a good chance to delve into the enigma that lies between the Emperor and the “Renunciation of War”.

Concerning who first conceived the idea of the “Renunciation of War” in the Japanese Constitution (1947), there seems to have been a variety of debates even among
scholars, politicians and journalists in Japanese post-war history. Through the Japanese media and Japanese education, both of which don’t seem to feel much
inconsistency over the co-existence of Article 1 and Article 9, we, the post-war generation, have been inculcated that Article 9, in particular, is the proof that shows
deep remorse and conscience of the Japanese people and the government that caused so much damage during the 15 Year War ending in 1945


It was noon on Jan.24, 1946 when then prime minister Kijuro Shidehara called on General Douglas MacArthur at his office located adjacent to the Imperial Palace to hand over a letter to him. Shidehara himself was well aware that GHQ was adamant to enforce the clauses specified in the Potsdam Declaration, where it declared The elimination “for all time [of] the authority and influence of those who have deceived and misled the people of Japan into embarking on world conquest.” (Wikipedia; Potsdam Declaration, the underline, Kasai). As Shidehara himself was a prime minister who had devoted himself with sincerity to the Emperor, it was a matter of course for him to consider that it was his supreme duty to make every effort to exonerate the Emperor and the Imperial Court System from any kind of war responsibility. In a book written by MacArthur, it is written that MacArthur himself was so dumfounded as to “make his knees crumble under himself” (『マッカーサー大戦回顧録』下p.240) by Shidehara’s suggestion. In short, Shidehara’s framework of the “Renunciation of War” was almost the same as MacArthur’s which had envisaged the world without wars.

The idea of “Renunciation of War” written in the letter to MacArthur was originally proposed by Toshio Shiratori. Shiratori was an ex-ambassador to Italy and played an active role in forming the Tripartite Pact with Germany and Italy. After the War he was indicted as a Class-A war criminal, incarcerated in Sugamo Prison and died of cancer there in 1949. It was Dec.10, 1945 when he sent a letter written in English from there to Foreign Minister Shigeru Yoshida. The Asahi Shimbun Newspaper reported the details on Aug.14, 2005.

Ex-Ambassador Shiratori had played an active part as an innovative bureaucrat in theForeign Ministry close to the military and became an Italian ambassador in 1938. He promoted the Tripartite Pact and also took the seat for the House of Representatives. The letter was dated Dec.10, 1945. The original was written in English and was delivered to Foreign Minister Yoshida from Sugamo Prison where he was incarcerated under the designation as a war criminal. According to the letter,only by linking inseparably the Emperor clauses with the Renunciation of Warand by making this part of the Constitution impossible to revise, we can guarantee eternal peace for the nation and preserve the Imperial Court System. The linkage between the Renunciation of War and the Emperor clauses can make the Imperial Court System survive, so emphasized Shiratori. What Shiratori intended to do was to create an idea that enabled the former enemy countries to soothe their feelings of animosity with an unprecedented declaration of the “Renunciation of War” in exchange for the Emperor’s status remaining intact. The letter was said to be handed over on Jan.24, 1946. The Asahi Shimbun Newspaper reports as follows.

The possibility is high the letter was delivered to Shidehara prior to his meeting with MacArthur via Foreign Minister Shigeru Yoshida.”
“The idea of incorporating the Renunciation of War into the New Constitution is believed to have been submitted by Shidehara at MacArthur-Shidehara talk on Jan.24, 1946. However, no conclusion has yet been reached as to who first suggested it or whether it was a collaboration between the two. It is highly conceivable that, around Jan.20, the censorship was lifted and the letter was submitted to Shidehara prior to his talk with MacArthur through Foreign Minister Shigeru Yoshida. Now the situation in and around the letter written in English by Shiratori seems to have become clearer. It would be a matter of course for Prime Minister Shidehara to have made no mention of the name Shiratori who was incarcerated in prison as a Class-A war criminal. No one except Prime Minister Shidehara knew whether or not the English letter written by Shiratori was exactly the same as the one handed over to MacArthur, but it appears obvious that Shiratori’s intention did reach MacArthur. MacArthur himself admitted in his autobiography saying that the proposal was submitted to him from the side of Prime Minister Shidehara.

They say the clause of the Renunciation of War was forced by my personal order. This is incorrect as the following facts suggest.Baron Shidehara called on me at my office at noon on Jan.24,(1946).Prime Minister suggested then that, in writing the Japanese Constitution, Japan should include the clause of the Renunciation of War and, at the same time, strictly refrain from having any military structure in that clause. MacArthur’s autobiography clearly shows that the idea of theRenunciation of Warin the Japanese Constitution was NOT initially forced by MacArthur. However, now that almost 70 years have passed since the end of the War, Prime Minister Shinzo Abe who has looked upon the “Pacifist Constitution” as the one forced by the U.S.-led Occupation Forces is said to have been intent on gutting the “Pacifist Constitution”.

Despite being a country which is supposed to have no armaments, Japan has imperceptibly become a militarily big country parallel to other major powers. Through the media and so on, Prime Minister Abe also must have read the “behind-the-scenes” tactics Ex-Italian Ambassador Shiratori and Prime Minister Shidehara had contrived for the sake of the Emperor. If he dares to revise the “Peace Constitution”, he has to make an explanation about the reason together with “behind-the-scenes” tactics and the process of the formation of the “Renunciation of War” to the Japanese people in the first place.
   In the post-war history, there is a lawmaker (an expert on the New Japanese Constitution) in Yamanashi-ken who called Prime Minister Shidehara’s tactics “A secret of the secrets”. This secret will be probed further next time.

「天皇を中心とする神の国」の秘話―(1)「戦争放棄」

 ノーベル賞と「戦争放棄」の関係について

日本と世界の多くの人々は、日本国憲法の「戦争放棄」の条項は、占領軍とアメリカ合衆国により日本が一方的に押しつけられたものと考えているかもしれない。しかし、以下のような資料と分析は、これが正しくないことを示している。日本国憲法成立の秘話を知らされていない世界の人々は、「戦争放棄」が導入された過程を知ってきっと驚くだろう。人類史において自衛は人間にとって固有の権利であると解釈されてきた。それにもかかわらず、戦後の日本は新憲法の中でそのような基本的権利の放棄を宣言し、日本は永久に戦争を放棄すると明記したのである。なぜか。

 2014 710日、私は午後5時ごろ始まるテレビ番組スーパー・Jチャンネルで興味深いテレビ番組を見る機会があった。焦点は天皇と憲法9条との関係である。コメンテイターである萩谷順法政大学教授は、もし「平和憲法」で知られる日本国憲法がノーベル平和賞に選ばれた場合、誰が授賞式に行き受け取る資格があるのについてコメントを行なった。萩谷教授の答えはよどみのないものであり、国の象徴であるという理由で、日本人を代表して明仁天皇(または代理)が出席すべきであると語ったのである。

 一般の視聴者、国会議員、天皇、そしてその家族たちは、全国に配信されたこの番組にどう反応したのであろうか。その話題は10分あるいは15分続いただけなので、視聴者の多くは番組の細かい中身については注意を払わなかったかもしれない。ただ「天皇を中心とする神の国」を推進してきた人々だけは、この「突然の」天皇利用の考えに違和感を覚えたことであろう。また、そのような世俗的なことへの天皇利用は不適切であると感じた人たちもいたかもしれない。いずれにしても、日本は言論の自由が保障され、基本的人権や人間の尊厳を冒さないかぎりいかなる話題も認められているから、私はこの機会に、天皇と「戦争放棄」の間に存在する謎について掘り下げてみたいと思う。

 日本国憲法の「平和条項」の起原について
   日本国憲法(1947年)にある「戦争放棄」をだれが最初に考えたかに関しては、戦後史において学者、政治家、あるいはメディアの中でさまざまな議論がなされてきているように思える。日本のメディアや日本の教育は双方とも憲法第1条と憲法第9条が併存することに矛盾を感じていないように思えるが、我々戦後世代は、特に第9条は1945年に敗戦となった15年戦争で多大な損害を与えた日本人と日本人政府の深い自責の念と良心を示す証拠であると教えられてきた。

1946124日正午のことである。当時の首相である幣原喜重郎はダグラス・マッカーサー元帥に1通の手紙を手渡すために皇居近くの元帥の事務所を訪れた。幣原自身ポツダム宣言に明記された条項、つまり「日本国民を欺いて世界征服に乗り出す過ちを犯させた勢力を除去する」(「ポツダム宣言」『ウィキペディア』)についてGHQが強硬姿勢であることを理解していた。幣原首相は天皇に忠誠を尽くしてきた首相であったので、天皇や天皇制をいかなる戦争責任からも免除させる努力をすべき義務があると考えたのは当然のことである。幣原の「戦争放棄」の提案を聞いたマッカーサーは、自著(『マッカーサー大戦回顧録』[] p.240)の中で、「腰が抜けるほどおどろいた」と書いている。戦争なき世界の構築はマッカーサーの考えと同じだったからである。

マッカーサーへの手紙に書かれた「戦争放棄」の考えは、本来白鳥敏夫によって提案されたものである。白鳥は、日本・ドイツ・イタリアの三国同盟の締結に積極的な役割を演じた元イタリア大使であった。戦後彼はA級戦犯として告発され、巣鴨プリズンに収監され、1949年にそこでガンで死んでいる。彼がそこから吉田茂外相宛てに英語で書かれた手紙を送ったのは19451210日のことであった。

  白鳥が手紙の中で意図したことは、天皇の地位を従来のままに据え置く代わりに、前例のない「戦争放棄」の宣言により旧敵国の憎悪を鎮めることができるとの考えであった。その手紙は1946124日に手渡されたと言われる。朝日新聞は次のように報じている。

「(白鳥が書いた)その手紙は、幣原がマッカーサーに会う前に、吉田茂外相を通じて幣原に届けられた可能性が高い」

「戦争放棄を新憲法に盛り込む発想は46124日のマッカーサー・幣原会談で出たとされる。幣原が言い出したとされるが、どちらから出たのか、あるいは合作かについては論争があり、決着はついていない。120日ごろに検閲が解除され、吉田外相を通じてマッカーサーとの会談前の幣原首相に届けられた可能性が高い。」(『朝日新聞』2005814日)

 ここにきて、白鳥が英語で書いた手紙をめぐる状況がはっきりしてきたように思える。幣原首相がA級戦犯として巣鴨プリズンに拘留中の白鳥の名前を口にしなかったのは当然のことであろう。白鳥によって書かれた英文の手紙がマッカーサーに手渡されたものと同じであるか否かについては、幣原首相以外知る者はいないであろう。しかし、明らかなことは、白鳥の意図が幣原を通じてマッカーサーに伝わったということである。マッカーサー自身彼の自伝の中で、その申し出を提出したのは幣原首相の側からであったことを認めている。

「日本の新憲法にある『戦争放棄』条項は、私の個人的な命令で日本に押しつけたものだという非難が、実情を知らない人々によってしばしば行われている。これは次の事実が示すように、真実ではない。(略)幣原男爵は124日(昭和21年)の正午に、私の事務所をおとずれ、(略)首相はそこで、新憲法を書上げる際にいわゆる『戦争放棄』条項を含め、その条項では同時に日本は軍事機構は一切もたないことをきめたい、と提案した。そうすれば、旧軍部がいつの日かふたたび権力をにぎるような手段を未然に打消すことになり、また日本にはふたたび戦争を起す意思は絶対にないことを世界に納得させるという、二重の目的が達せられる、というのが幣原氏の説明だった。」(『マッカーサー大戦回顧録』[] pp.238240

マッカーサー自伝は、日本国憲法の『戦争放棄』の考えが当初マッカーサーによって押しつけられたものではないことを明らかに示している。しかしながら、戦後70年を目前にした今、日本では「平和憲法」をめぐり様々な論議が起きている。自由民主党の安倍晋三首相は日本の「平和憲法」はアメリカ主導の占領軍によって強制されたものであると理解し、「平和憲法」を骨抜きにしようとしていると言われている。

軍備を持たないはずの「平和憲法」を高く掲げる日本は、現在世界の強国に肩を並べるほどの軍事大国の一つとなっている。新聞報道等を通じて、安倍氏も白鳥元イタリア大使や幣原首相が天皇のために考え出した「裏工作」について読んだであろう。もし「平和憲法」を改正するというのなら、なぜ必要なのかについて、安倍首相は国民に対し憲法制定当時の「平和憲法」や「戦争放棄」の理念と成り立ちの経緯を説明しなければならない。
   戦後史の中で、幣原首相の「裏工作」を「秘中の秘」と名づけた国会議員(日本国憲法の専門家)が山梨県にいたが、その内容については次回ということにしたい。


The inside story of the “Nation of God with an Emperor at the Center”―(2)“A top secret of the secrets”

  Why is the name of the man who proposed Renunciation of War in the Japanese Constitution (Toshio Shiratori) obliterated from the post-war history of Japan?

The year 2015 is the 70th anniversary of the end of the World War. Lots of articles in domestic newspapers and TV programs are reiterating the importance of preventing the memories of the war from fading with time. However, it has become a matter of course that the memories of the Japanese people wear thin with time when the Japanese government and the education ministry are reluctant to teach the truth about the war.

 In the last report I introduced a newspaper article (Asahi Shimbun Newspaper, Aug 14, 2005) that reported to the effect that the man who originally proposed the idea of Renunciation of War for the Japanese Constitution was possibly Toshio Shiratori, an ex-ambassador to Italy. Shiratori is known today as a diplomat who tried to expedite the Tripartite Pact, and after the war, he was indicted as a class-A war criminal and incarcerated at Sugamo Prison.

Around the time of his incarceration, Shiratori made a couple of surprising suggestions related to the future of the Emperor and post-war Japan. Not only did he suggest the idea of transforming the Emperor into a Christian, but also he created an idea for the Renunciation of War in the hope that the Emperor would be acquitted from any war crimes in exchange. He died of cancer in 1949 half a year after his life sentence was imposed by the Tokyo War Crimes Tribunal, but, from there, it is reported that he entrusted a letter written in English to Foreign Minister Shigeru Yoshida, hoping it to be handed over to General MacArthur.

Despite the fact that post-war Japan has been a nation based on the idea of Renunciation of War, no Japanese people, even lawmakers, seem to have been informed of the origin of the clause of Renunciation of War. They seem to believe that the idea was forced upon Japan by the United States.

Mr. Hisatada Hirose, a health minister during World War (and the 2nd president of the Alumni Association of Hikawa Senior High School [1964~1971]) expressed his idea that the real reason for the existence of the Renunciation of War clause in the Japanese Constitution was “A top secret of the secrets”. What did he want to say by this? In my opinion, this shows that not only Mr. Hirose but also the majority of the then-lawmakers were left on the sidelines of the plot to prevent the Emperor from standing before the court as a war criminal.

“It is a matter of course that the reason for the legislation of this extreme pacifism [Article 9 of the new constitution] is interpreted as the ‘ardent desire for peace’, but behind the scenes, as a top secret of the secrets, we have to read through the intention of preserving the Imperial Court System. A war-time health minister who first attempted to revise the Peace Constitution

In Yamanashi Prefecture, Mr. Hirose was noted as a high-profile politician who graduated from what is now called Hikawa Senior High School, and studied at Tokyo University. During the war, he assumed the position of health minister twice, once in 1940 (the Koiso Cabinet), and the other, in 1944 (the Yonai Cabinet).

 After the War, Mr. Hirose was purged from the political circles, but successfully returned as a lawmaker in the House of Councilors in 1953 and published a book entitled “DRAFT OF THE REVISED CONSTITUTION OF JAPAN ” in 1961(the first one, in 1957). In this book, he made clear his intention of revising the Japanese Constitution in order to make it so that the Japanese people could once again feel proud of themselves. As for Article 1, he wrote the Emperor is “the center of national unity” instead of “the symbol of the state”. His book became one of the major guidelines for the revision of the Japanese Constitution by the conservative Liberal Democratic Party. Let’s listen to Mr. Hirose’s reason for the revision.

Here Mr. Hirose stressed the need for the “sweeping revision” of the New Constitution. He also wrote another autobiographical book entitled 『無我献身』“Self-effacing Devotion”, but there must be many readers who couldn’t find even a bit of conscience or a sense of responsibility from the author as one of the political leaders who led the wartime cabinets. On the contrary, his criticism was directed only at the Japanese Constitution for the reason that it was “enacted while under occupation by foreign military forces”. After reading Mr. Hirose’s explanation for the need for revision of the Peace Constitution, I find a common mentality shared by conservative LDP politicians today, including Prime Minister Abe.

  “It is an unmistakable fact that the Constitution was drafted by 25 people at the General Headquarters of the Supreme Commander for the Allied Powers over a short period during the occupation,” Abe told a recent Diet session. He also said earlier that the Constitution’s basic framework needs to be revised “for Japan to regain a true independence”. (Japan Times, March 14, 2015)

It may be true that the Peace Constitution was drafted by a small number of Americans, but Abe made no mention of the role Shiratori, who was incarcerated in Sugamo Prison, played at the initial stage of drafting the Peace Constitution. Though there is span of more than 50 years between the two comments released respectively in 1961 and 2015 by Mr. Hirose and Prime Minister Abe, the core of their comments appears to be exactly the same. What Abe wants is to go back to the “normal nation”, where the Japanese people used to live happily without any intervention of outsiders. They thought it unpardonable to have the Divine Nation transformed into such an “abnormal nation” that merely follows in the footsteps of the United States. Simply following the United States is a great blow to their pride.

I wonder: Were Mr. Hirose and Prime Minister Abe informed of the existence of the actual person who suggested the idea of the Renunciation of War? If Mr. Hirose and Prime Minister Abe had been taught about the inside story suggested by Toshio Shiratori in Sugamo Prison, is it possible for them to insist that the clause of the renunciation of war was forced upon Japan by the United States?

In the management of the postwar strategy, General MacArthur at first appeared to let the Japanese government handle rebuilding the war-torn nation on its own initiative. Including the clause of Emperor, it is reported that MacArthur had already decided to let the Imperial Court System survive mainly because Japan without an emperor at the center would cause internal chaos and require the United States another 1 million soldiers.

The Japanese Government was extremely adamant against the demand of the U.S. Forces to remake the Japanese system into a more democratic one. The draft submitted by the Japanese side (Matsumoto ProposalsMatsumoto was a state minister) for the revision of the former constitution (Meiji Constitution) fell far short of what MacArthur wanted.

At this stage, it was apparent that the Japanese Government had neither the idea of transforming the status of the emperor nor the idea of demilitarizing the Japanese Imperial Army. Article 6 of the Potsdam Declaration following the war says as follows:

Japan acquiesced to the Potsdam Declaration and the Unconditional Surrender, but, for the Japanese war-leaders, historically saying, it is not necessarily wrong to dupe enemies to take advantageous positions as they did prior to and during the war. For example, the invasion into Manchuria in 1931 without declaring war, the secession from the League of Nations in 1933, the surprise attack on Pearl Harbor in 1941, and so on, were only the tip of the iceberg for the Divine Nation to be labeled as a rogue nation internationally. In spite of the Unconditional Surrender, the war leaders including Emperor Hirohito still had no ears to listen to the voices from outside regarding what are perceived from outside as wrongful acts.

It was at this time when Shiratori’s truly mind-boggling suggestion from Sugamo Prison reached the ears of Prime Minister Shidehara via Foreign Minister Yoshida. Let us briefly look back again to when the letter containing the idea of Renunciation of War was handed over to General MacArthur.

It is written here that the date of the suggestion of Renunciation of War was delivered from Shiratori in Sugamo Prison to Foreign Minister Shigeru Yoshida was December 10. This means that the letter (or its purport) had been kept for more than a month in the hands of Foreign Minister Yoshida or shared between Yoshida and Prime Minister Shidehara before the letter was handed over to MacArthur on January 24. Even State Minister Matsumoto who was in charge of the Constitution was not a member of the tactic. As the Matsumoto Proposals were so disappointing as discussed above, MacArthur made public his own, so called, Three Principles on February 3. Here we need a close look at the similarity between MacArthur’s principles and Shiratori’s suggestion (Previous report 4).

(2)  War as a sovereign right of the nation is abolished. Japan renounces it as an instrumentality for settling its disputes and even for preserving its own security. It relies upon the higher ideals which are now stirring the world for its defense and its protection.  No Japanese Army, Navy, or Air Force will ever be authorized and no rights of belligerency will ever be conferred upon any Japanese forces.
(3) The feudal system of Japan will cease.

On another viewpoint, I wonder: Did the Emperor know about Shiratori’s “behind the scenes” tactic? Probably he didn’t. It is inconceivable that anyone around the Emperor made an attempt to inform him of the inside story of his fate being balanced with the idea of the Renunciation of War. Let us take a listen to the following story. In later years, when Shiratori was enshrined in the Yasukuni Shrine, Emperor Hirohito was reported to have expressed his discomfort and ceased visiting the shrine thereafter (“Tomita Memorandum” 1988). I suppose the royal subjects dared not let the Emperor know about the tactic suggested by Shiratoti.

In a nutshell, Shiratori’s historic “feat” was performed by a couple of top leaders, handled secretly and doomed to be buried in the darkness of postwar history. Even a noted American historian, John Dower views Prime Minister Shidehara’s recollection as rather negatively in his book published in 2000, and makes no mention of the English letter originally written by Shiratori in Sugamo Prison, either.

   “On the other hand, Former Prime Minister Shidehara, who had tearfully told his ministers that he could only expect contempt from subsequent generations, came in later years to claim proudly that he himself had first mentioned the ideal of renouncing war to General MacArthur. This was in all likelihood just the mistaken recollection of an elderly man but, whether fact or fiction, his sincere embrace of the “no war” ideal gave credibility to the argument that, when all was said and done, the new constitution had indeed reflected Japanese ideals.” (EMBRACING DEFEAT, p.404, Published in 2000)

I’ve tried to read the last few lines repeatedly. If read correctly, this historian also doesn’t seem to have known the initial proposer of the Renunciation of War clause in the Japanese Constitution (I mean, of course, Former Italian Ambassador Toshio Shiratori). Dower called Shidehara’s assertion “the mistaken recollection of an elderly man”, and also said, “but whether fact or fictionthe new constitution reflected Japanese ideals”. If he had known about Shiratori’s tactic, he may have written from a different perspective. At least my view is that the tactic toward MacArthur from the Japanese side was not initially intended to aim for world peace but merely to ensure the safety of the Emperor and the Imperial Court System.

A Yamanashi-born war-time lawmaker, Mr. Hirose, also seems to have had no chance to understand how the idea of Renunciation of War was brought into Japanese Constitution. Mr. Hirose may have started his idea of revising the Constitution soon after he was freed from the “house arrest” imposed by the Occupation Forces. In the following two articles, he appears to have expressed his belief that the advocator of Renunciation of War was Prime Minister Shidehara.

As far as I know, when Prime Minister Shidehara submitted the idea of Article 9 to MacArthur, he did not bother to consult with other ministers. Anyhow I can’t believe Shidehara made such an ‘absolute pacifism of renunciation of war’ by his own initiative, but it is quite unlikely that MacArthur made a false statement. Prime Minister Shidehara is a person who had already passed away. 日本国憲法に戦争放棄の条項を提案した白鳥敏夫は、なぜ日本の戦後史から消されるのか

2015年という年は、第二次世界大戦後70周年にあたる年である。多くの国内の新聞記事やテレビ番組は、戦争の記憶の風化をくい止めることの重要性を繰り返し述べている。しかしながら、日本の政府や文部科学省が戦争の真実を伝えることに消極的であるとき、日本人の記憶が風化するのは当然のことと言わねばならない。

前回の報告で筆者は、戦争放棄で知られる日本国憲法9条の最初の発案者が白鳥敏夫・元イタリア大使である可能性に関する新聞記事(『朝日新聞』2005814日)を紹介した。白鳥は今日、日独伊三国同盟締結を促進した外交官として知られているが、戦後彼はA級戦犯として告発され、巣鴨拘置所に収監された人物である。

 収監されていた頃の白鳥は、天皇と戦後の日本に関するいくつかの驚くべき提案をしている。彼は、天皇を戦争犯罪から救い出すためにキリスト教徒に改宗させることのほか、天皇の免罪との交換に、新憲法に戦争放棄を盛り込むことを提案したのだ。白鳥は東京戦争裁判法廷により終身刑を下されて半年後の1949年にガンで死亡しているが、そこから彼は吉田茂外相に対し、マッカーサー宛てと思われる英語の手紙を託したと報じられている。

 戦後の日本は戦争放棄の考えを基本とする国として知られてきた事実にもかかわらず、一般国民はもちろん国会議員でさえも、戦争放棄の起原については知らされてはこなかったと思われる。彼らは、その考えはアメリカ合州国により押しつけられたと信じているようだ。

広瀬久忠氏(第2代日川高校同窓会会長〔1964年~1971年〕)は、第二次世界大戦中に厚生大臣を務めた人である。彼は戦争放棄の条項が日本国憲法に存在する本当の理由については「秘中の秘」だとしているが、これによって彼は何を言いたかったのであろうか。このことについて私は、広瀬氏ばかりでなく当時の国会議員の大多数が、天皇を戦争犯罪人として裁く法廷への出廷を阻止する策略には関与してはいなかった、と推測している。この読みは正しいだろうか。

平和憲法改定を最初に試みた戦時中の厚生大臣

  山梨県出身の広瀬氏は、現在の日川高校を卒業後東京大学で学んだ著名な政治家として知られていた。戦時中の広瀬氏は、2度厚生大臣を努めている。1度目は1940年の小磯内閣の時、2度目は1944年の米内内閣の時である。

敗戦後、広瀬氏は政界から追放されたが、1953年には参議院議員として見事復活を果たし、1957年に引き続いて1961年には『再建日本の憲法構想』というタイトルの本を出版している。この本の中で広瀬氏は、自らを誇りに思う日本人をつくるためには日本国憲法を改正する必要がある、との意図を明らかにした。第1条は、天皇は「国のシンボル」から、「国民統合の中心」と変更したが、彼の本は保守的な自由民主党による憲法改正のための最初の主要な案内書の一つとなった。まず、広瀬氏の改正理由について聞いてみよう。

「…わが国の歴史と伝統を深く理解し、日本国民の生命や魂のたゆまざる成長を確たるものにするために、ここに占領下で外国軍により制定された日本国憲法の包括的な改定を行ない、国民の生命の基盤を確立することを願うものとする。」(『再建日本の憲法構想』末尾の英文・広瀬久忠、部分訂正―ジム・ハラット(校正)、和訳・河西)

 ここで広瀬氏は、新憲法の“包括的な改定”の必要性を強調している。彼は他にも『無我献身』というタイトルの自伝を書いているが、多くの読者は戦時内閣を支えた政治指導者の一人としての著者のわずかな良心や責任感さえ見出すことができないだろう。逆に、彼の批判は、それが“外国軍による占領下で制定された”という理由で、もっぱら日本国憲法に対して向けられている。広瀬氏の平和憲法改定理由の説明を読んだ私は、安倍晋三首相を含む今日の保守的な自民党政治家たちの考え方との共通性を見出している。

「『憲法が占領中の短期間に連合軍最高司令官総本部で25人の人々により草案化されたことは、誤りなき事実である』。安倍首相は最近の国会審議でそう語った。彼はさらにこれに先立ち、憲法の基本構造は『日本が真の独立を獲得する』ために改定する必要があるとも述べた。」(『ジャパン・タイムズ』2015314 和訳・河西)

 平和憲法が少数のアメリカ人によって草案化されたことは事実であろう。しかし安倍首相は、巣鴨拘置所にいた白鳥が平和憲法草案の初期の段階で果たした役割について一言も触れていない。1961年と2015年に出された広瀬氏と安倍首相の発言には50年以上の開きがあるが、彼らの主張の中身には違いはないと思われる。安倍氏が求めているのは「正常な国家」への回帰であり、そこはかつて日本人が部外者の干渉を受けることなく幸福な生活を送っていたところであった。彼らにとって、「神の国」がアメリカに従うだけの「異常な国家」へと変えられたのは、許すことのできないことだった。アメリカのくびきのもとにあり続けるには、彼らのプライドはあまりに高かったのである。

疑問に思うのは、そもそも広瀬氏や安倍首相は、戦争放棄の考えを最初に提案した人物について知らされていたのかということだ。もしもこの二人の政治家が、巣鴨拘置所にいた白鳥の策略について知らされていた場合、彼らは戦争放棄の条項はアメリカによって強制されたと主張することは可能なのだろうか。

戦後日本の管理について、マッカーサーは当初、戦禍に引き裂かれた国家の再建を日本の自発性に委ねようと考えていたようだ。天皇条項を含め、マッカーサーはその時すでに天皇制の存続を決めていたと言われている。主な理由として、中心に天皇がいない日本は内部的混乱を引き起こし、アメリカにさらに100万人の兵士を要求することになるという見方が挙げられていた。

 日本政府は、日本のシステムをより民主的なものにつくり変えようとするアメリカ軍の要求に対し、強く抵抗した。旧憲法(明治憲法)改定のために日本側が提出した草案(松本試案―松本は国務大臣)は、マッカーサーが日本国憲法に求めていたものとは大きな隔たりがあった。

(1)  天皇が統治権を総攬せられるという大原則にはなんら変更を加えないこと
(2)  議会の議決を要する事項を拡充すること。その結果として従来のいわゆる大権事項をある程度制限すること。
(3)  国務大臣の責任を国務の全般にわたるものたらしめ、国務大臣以外のものが、国務に対して介在する余地なからしめること、そ  して同時に、国務大臣は議会に対して責任を持つものたらしめること。
(4)  人民の自由及び権利の保護を強化すること。またこの自由と権利の侵害に対する救済方法を完全なものとすること。(『敗北を  抱きしめて』下119頁~120頁)

 この段階での日本政府には、天皇の地位を変更する考えもなければ、日本の皇軍を非武装化する考えもなかったことは明らかである。ポツダム宣言第6条にはこう書かれていた。

「吾等ハ無責任ナル軍国主義カ世界ヨリ駆逐セラルルニ至ル迄ハ平和、安全及正義ノ新秩序カ生シ得サルコトヲ主張スルモノナルヲ以テ日本国国民ヲ欺瞞シ之ヲシテ世界征服ノ挙ニ出ツルノ過誤ヲ犯サシメタル者ノ権力及勢力ハ永久ニ除去セラレサルへカラス」

 日本はポツダム宣言と無条件降伏とを受け入れたが、日本の戦争指導者たちにとっては、歴史的に言って、有利な立場を保持するために敵を騙(だま)すことは必ずしも悪いことではなかった。戦前・戦中の事例で見るとおりである。例えば、宣戦布告なしの1931年の満州への侵略、1933年の国際連盟脱退、1941年の真珠湾への奇襲攻撃など、これらは「神の国」が国際的に「ならず者国家」の烙印を押される理由の氷山の一角であった。無条件降伏にもかかわらず、天皇を含む日本の戦争指導者は、非道な行為を指摘する外部の声に耳を傾けることはなかったのだ。

 巣鴨拘置所にいた白鳥から驚くべき提案が吉田外相を通して幣原首相に伝えられたのは、そのような時であった。戦争放棄の考えが書かれた手紙がマッカーサー将軍に手渡された頃の謎めいた動きについて、簡単に振り返ってみよう。

 ここには、戦争放棄の提案が巣鴨拘置所の白鳥から吉田茂外相に送られた日付、それは1210日だったと書かれている。このことは、その手紙(あるいはその趣旨)が124日にマッカーサーに手渡される前の1か月以上の間吉田外相の手元にあったか、あるいは吉田外相と幣原首相の間で保管されていたことになり、憲法担当の松本国務大臣には伝えられなかったことになる。上述したように、松本書簡はあまりに失望させるものであったという理由で、マッカーサーは23日にいわゆる「3原則」を明らかにしたのである。ここで私たちは、マッカーサーの原則と巣鴨拘置所で書かれた幣原の提案(前号報告書参照)との類似点を見る必要があるだろう。

(2)  国の主権のひとつとしての戦争は、廃止される。日本は、自国の紛争解決のための手段としての戦争、さらには自国の安全を保持する手段としての戦争でさえも放棄する。日本は、その防衛と保護を、今や世界を動かしつつある、より崇高な理想に委ねる。日本のあらゆる陸海空軍はけっして認可されず、あらゆる交戦権はいかなる日本軍にも与えられない。」

 私が疑問に思うもう一つの視点がある。天皇は、一体白鳥の「舞台裏」の策略について知っていたのであろうか。おそらく知らなかったであろう。天皇の周囲にいる者が天皇に対し、天皇の運命と戦争放棄の条項とが交換条件になっているという裏話を伝える人がいたとは考えられない。こんな話もある。後年白鳥が靖国神社に合祀された際、天皇は「不快感」を示して、それまで続けていた靖国参拝を取りやめたというエピソード(『富田メモ』1988)が伝えられている。私は、忠臣たちは天皇に対し、戦争放棄についての裏話を知らせなかったと推測している。

要するに、白鳥の歴史的「偉業」は数人のトップの指導者たちによって扱われ、秘密裏に処理され、戦後史の闇に葬り去られる運命となったのだ。著名なアメリカ人歴史家のジョン・ダワーでさえ2000年に出版された著書『敗北を抱きしめて』のなかで、以下のように幣原首相の回想を否定的にとらえており、白鳥から吉田外相に届けられた英文の手紙についても言及していない。

「他方、自分たちは後世の人々から軽蔑を受けるだけだろう、と涙ながらに閣僚を前に語った前総理大臣・幣原は後年、自分こそがマッカーサー元帥に戦争放棄の理想を最初に語ったのだ、と自負心をもって主張するようになった。これは十中八九、たんに年老いた男の思い違いの感想であろう。― しかし、それが事実であれ作り話であれ、幣原が『反戦』の理想を心から受け容れたことは、新憲法が結局の所、確かに日本の理想を反映していたという主張の真実性を補強する事実であった。」(『敗北を抱きしめて』下193頁)

私はこの数行を繰り返し読んだ。もし読みが正しいとするならば、この歴史家もまた、日本国憲法に戦争放棄を盛り込むよう提案したという最初の人物(白鳥敏夫・元イタリア大使)が果たした役割を知らなかったのではないか。ダワーは、『幣原の主張は年老いた男の思い違いの感想』と述べ、さらに、『しかし、それが事実であれ作り話であれ…新憲法は日本の理想を反映するものだった』と語っている。もしダワーが白鳥の策略を知っていたならば、彼は異なる視点から書いていたであろう。少なくとも、日本側が放った策略は世界平和を目的として意図されたものではなく、たんに天皇と皇室の安全とを確保するために仕組まれたものだったというのが私の見方である。

 山梨県生まれで戦時下の国会議員でもあった広瀬氏もまた、戦争放棄の策略がどのようにしてつくられたのか理解する機会がなかったのであろう。広瀬氏は、占領軍によって課された「自宅謹慎」から解除された後、すぐに憲法改定の研究をスタートさせたものと思われる。つぎの記述は、広瀬氏が戦争放棄の主唱者は幣原首相であると信じていたことを示す文章であろう。

  「マ元帥は、憲法第9条は幣原首相の発意によるものだと証言した」(広瀬久忠)
「マ元帥は米国上院で、日本国憲法第9条は幣原首相の発意によるものだ、と証言した。この証言は日本国民をびっくりさせた。当時幣原首相の側近には、憲法担当の松本国務大臣もいた。多数の信頼すべき有力閣僚もおった。然るに私の聞く限りにおいては、幣原首相は第9条に該当する発意を、マ司令官にするにつき、閣僚に何んらの相談もしていない。独断でマ司令官に対してのみ『絶対平和主義戦争放棄』の発意をしたと云うが如きは、どう考えても信じられないことである。然し元帥が虚偽の証言をなすが如きこともあり得ない。幣原首相は既に故人である。今日ではマ元帥の証言を信ずる外はない。」(『再建日本の憲法構想』89頁)

「これが幣原首相の秘中の秘ではなかったか」(広瀬久忠)
以下は全く私の推測であるが、幣原首相の皇室に対する忠誠心は、首相の胸を燃やしたのであろう。それは戦争完全放棄を憲法に明記して、天皇と軍国主義との関係を永久に断つことを世界に宣明することこそが、わが天皇制を護り貫く途である、との考えではなかったか? 天皇制護持をつつむに絶対平和主義を以てすること、これが首相が憲法担当の松本国務大臣にも、又他の閣僚にも何事も相談することなく、マ元帥のみに訴えた秘中の秘ではなかったか。」(『再建日本の憲法構想』89頁)

 “A Senior High School that is on the cutting-edge” ??

 The year 2015 marks the 70th anniversary after World War II, and various events were planned in lots of places. An exhibition entitled “The War Exhibition in the Hope of Peace” was held for six days, from July 26 to July 31, at the event space in the Yamanashi Prefectural Library, located near the northern exit of Kofu Station. As one of the participants, we, “The  Society of Yamanashi Citizens suing Hikawa S. High School Song that includes the “Rescripts of Emperors", exhibited eight panels and argued the unconstitutionality of the school song.

The overall response to the Exhibition, thus far, has been rather supportive of our opinions by saying that the school song of Hikawa High is anachronistic. But, this year, a different opinion caught our attention. According to an attendee, one senior citizen related to Hikawa S. High School was reported to have said that “Hikawa S. High School is on the cutting-edge”. This remark probably has a lot to do with the political maneuvers of Prime Minister Shinzo Abe, who keeps pushing his right-wing revisionist ideas in Japanese political circles. The senior citizen appears to have a hope that Hikawa S. High School is a herald of the revisions to come for the Japanese Constitution being pushed by the Abe administration.      

  A pioneer of the idea to revise the Japanese Constitution

Prime Minister Shinzo Abe, who has been known as a “constitutional revisionist”, must have learned a lot about political techniques through the book entitled “TENTATIVE DRAFT OF THE CONSTITUTION OF JAPAN AS REVISED BY HISATADA HIROSE”, written and published by Mr. Hirose in 1957. Just like Prime Minister Abe, Mr. Hirose (Second President of Alumni Association of Hikawa S. High School) has also expressed his opinion that the Japanese Constitution was forced upon Japan by the United States, and made public his idea of reinstating the “Nation of God with an Emperor at the Center”. In other words, the LDP, the party that has monopolized Japanese politics after the war, has long been holding on to the same revisionist party platform. Mr. Hirose’s first book was published in 1957 and later「再建日本の憲法構想」was also published in the so-called manual form in 1961. Mr. Hirose’s plan largely cites two reasons for the revision of the Japanese Constitution. One is the “coercion by the Occupation Forces”, and the other is that the current constitution is “unharmonious with the Japanese state of affairs”.

 “Regrettably, some expressions of the Japanese Constitution regarding democracy do not fit to the Japanese state of affairs. Expressions of democracy in the current Constitution put much emphasis on individual rights and less on obligation, which eventually would devalue the nation state to satisfy the individual.” (Bibl.[The gist] p.4, trans. The two reasons mentioned above by Mr. Hirose for revising the Constitution, however, completely lack responsibility for the war itself or accountability for the war crimes committed by Japan during the war.  Even though the New Constitution doesn’t fit to the “state of affairs,” as far as it was given universal values and beneficial to world peace, the above two reasons would eventually be labeled as too selfish. In addition, the notion of “the state of affairs in Japan” sounds like out-of-date ethnocentrism, and also reminds us of the ideas of the people educated before and during the war. In the following sections, I would like to inspect Mr. Hirose’s intentions regarding the revision.

Mr. Hirose’s Plan for Revising the Japanese Constitution

1.     The role and position of the emperor

The current Constitution of Japan Article 1 Emperor

Mr. Hirose’s plan Article 1 Fundamental character of Japan
 Japan shall be a democratic State having the Emperor as the center of national unity. (Bibl. p.1)

Mr. Hirose’s focal points were the revival of the authority of the Emperor and the restoration of the Japanese military. In order to realize his goals, the role and position of the Emperor needs to be clarified in the first place. The Emperor’s role has to be changed from “symbol” to “center of the national unity,” and his position has to become “head of the State.” While Mr. Hirose explains that “symbol” does not clearly express the role of the Emperor, he also hesitates the use of “head of the state” to define the Emperor’s role, because, he says, it might imply the resurgence of sovereignty of the Emperor. Though Mr. Hirose uses 首位 (the top) in Japanese for the translation of “head of the state”, as long as we read the English translation only, we can’t determine the covert intention Mr. Hirose applied to the phrase “head of the State”.

2. Revising the Preamble

If the word “symbol” were erased from the Constitution and the phrase “head of the State” is resurrected, the overall impression of the current Constitution will get closer to that of the former (Meiji) Constitution. Among the Articles that explicitly describe the reasons for the annulment and exclusion of Rescripts of Emperors are the Preamble and Article 98 of the current Japanese Constitution. The simplest way to revive the “Rescripts of Emperors” is to delete the Preamble and Article 98 from the Constitution. At first, let’s take a look at related sections of the Preamble of the current Constitution.

In Paragraph 1 of the Preamble of the current Constitution:
This is a universal principle of mankind upon which this Constitution is founded. We reject and revoke all constitutions, laws, ordinances, and rescripts in conflict herewith. (“The Constitution of Japan”―Web site)

In Paragraph 2 of the Preamble of the current Constitution:
We, the Japanese people, desire peace for all time and are deeply conscious of the high ideals controlling human relationship, and we have determined to preserve our security and existence, trusting in justice and faith of the peace-loving peoples of the world. We desire to occupy an honored place in an international society striving for the preservation of peace, and the banishment of tyranny and slavery, oppression and intolerance for all time from the earth. (“The Constitution of Japan”―Web site)

Mr. Hirose was not the type of person who could connect to the deep meaning of this Preamble, which appears to show sincere condolences to the war-sufferers, especially in Asia. What Mr. Hirose had in mind was just to reconstruct the former system he had long devoted himself to. But, ironically, he erased every inconvenient word and phrase from the current Preamble, including the Emperor’s remark “…trusting in the justice and faith of the peace-loving peoples of the world.” The sentence “We desire to occupy an honored place in an international society” was also deleted.

(2) The Japanese people have to be respected as individuals, and, as members of this nation, we have to enforce our national responsibility, so we proclaim.
(3) The Japanese people long for world peace. Therefore, in order to accomplish the realization of peace, it is a key for each country to achieve development on its own, which, we acknowledge, is the supreme principle for the survival of human beings. Accordingly we are encouraged to retain our own sovereignty and respect those of other countries. So we declare that mutual cooperation and harmony should be the guiding spirit in the international society. (Bibl. p.39~40 trans. Kasai)

3. Powers of the Emperor and National Defense

 A bid to revive the “Rescripts of Emperors”

If the change from “symbol” to “head of the state” actually happened to the position of the Emperor, lots of relics of the former regime would come to life. One of the most mind-boggling resurgences has already happened at the “cutting-edge” Hikawa S. High School: the declaration of “No. 1 High School in the Divine Nation”. This slogan was written by the 16th schoolmaster, Hyakushi Kondo (1966~1970), in the form of a poem, and printed as the official statement of the school in the book published as “100th anniversary of foundation of Hikawa S. High School” in 2001.

It is not surprising for us to see a common thread running between the tenures of schoolmaster Hyakushi Kondo and the 2nd President of the Alumni Association, Hisatada Hirose (1964~1871). During their tenures, the basis for the structure of the “No.1 High School in the divine nation” was formed, including the building of a monument to the Hikawa High School Song in the front garden of the school grounds.

Talking of the “Divine Nation,” or the “Nation of God with the Emperor at the Center,” every student who enters Hikawa High, each April, is subjected to brainwashing ceremony at the age of 15. They are ordered to sit on their legs on the floor of the auditorium and sing the school song until their voices get hoarse, chanting “With Rescripts of Emperors, now is the time to achieve feats”. This custom has often been criticized as too militaristic and even anachronistic, but, even today, this kind of “orientation” remains active in this Senior High School in Yamanashi Prefecture. Students who are brought up in this kind of educational environment, they will unknowingly nurture a special closeness toward the Emperor and consider it blasphemous to say something negative against the Emperor. In the Japan Times on Aug. 29, 2015, the following news article appeared.

Tokyo has sent a message of protest to Beijing over an editorial by China’s official news agency that demanded an apology from Emperor Akihito over Japan’s wartime actions in the country, Chief Cabinet Secretary Yoshihide Suga said Friday.…In the editorial, Xinhua claimed Emperor Hirohito, posthumously known as Emperor Showa, did not apologize to countries victimized by the war started by Japan and his son, Akihito, should apologize and repent to aid reconciliation”. (The Japan Times, Aug. 29, 2015)

   Against this editorial, Foreign Minister Kishida responded with the word “不敬 (blasphemous)” on TV, while Chief Cabinet Secretary Suga also commented with these harsh words: “very discourteous to the Emperor”, adding that “Yesterday, we strongly protested against China through a diplomatic channel”. (The Japan Times, Aug. 29, 2015). Do these Japanese top leaders understand what is being questioned by the victims? This is not a problem that can be shown by such words as “blasphemous” or “discourteous”. It is obvious that the Japanese side takes the Emperor as “head of the state” and/or somebody closer to the “Living God” mentioned in the former Constitution. This is in direct opposition to directives issued by the Diet after the war. The following directive by the House of Representatives explains how we should cope with “Rescripts of Emperors.”

“We annul the Rescripts of Emperors and do not admit the validity of their principles of guidance”. (“Resolution pertaining to the annulment of the Imperial Rescript of Education” House of Representatives) June 19, 1948
“…We admit that the fundamental idea of these Rescripts rests on the sovereign power of Emperors and the notion of a mythological formation of this country, the idea of which apparently mars the idea of fundamental human rights and leaves doubts about the international trust. Accordingly, pursuant to the true aim of Article 98 of the Constitution, the House of Representatives proclaims that we exclude these Rescripts and do not admit the principle of these rescripts. So we resolve”. (June 19, 1948. trans, Kasai)

Do the school song supporters of Hikawa S. High School dare to say this Diet Resolution was also forced upon Japan by the Occupation Forces? The Resolution by the House of Representatives adds, “The governments in the past haven’t performed enough administrative measures” and that “These outdated documents, Rescripts of Emperors, would be misunderstood by outsiders as if they were still living as guiding principles of this country”. Mr. Hirose knows quite well his idea is in violation of this “Resolutions by both Houses of the Diet”, but he simply adds, “Article 98 is unnecessary”.

Schoolmaster Yamamoto says no to the school song of his alma mater

In closing this short column, I have to refer to Mr. Masaaki Yamamoto, the 23rd schoolmaster of Hikawa S. High School (1985/4~1986/3). In the long history of Hikawa S. High School, he was the sole schoolmaster who said no to the school song carrying the phrase “With Rescripts of Emperors, now is the time to achieve feats”. He suggested to the people concerned to discuss further about the school song, which, he felt, goes against the Japanese Constitution, but he was intimidated with a series of anonymous telephone calls, and on the day of the general meeting of the Alumni Association, he was nudged in his ribs by an influential member of the Alumni Association. His regret of his inability to further the discussion, and his hopes for his alma mater are recorded in the afore-mentioned “100th Commemorative Issue” published in 2001. The senior citizen who said “Hikawa is on the cutting-edge” at the War Exhibition needs to read the page School Master Masaaki Yamamoto wrote. He says flatly, “All the Rescripts of Emperors have already been annulled and abolished.”

「最先端にいる日川高校」??

2015年の今年は戦後70年に当たり、各地でさまざまな催しが計画されている。「平和を願う戦争展」と名づけられた展覧会は、726日(日)から731までの6日間にわたり、甲府駅北口近くの山梨県立図書館イベントスペースで開催された。参加団体の一つとして、私たちは「日川高校『天皇の勅』校歌訴訟県民の会」)の名前で8点のパネルを出展し、山梨県立日川高校校歌の違憲性について議論した。

これまでの同展に対する大方の反応は、「日川高校校歌は時代錯誤である」として、私たちの考え方に賛同する意見が来訪者から寄せられていた。しかし、今年の「戦争展」では、ある一つの意見が注目を浴びた。係員の話によると、年配の日川高校関係者から「最先端にいる日川高校」という趣旨の声が寄せられたというのである。この発言は恐らく、現在日本の政界で右翼的改憲論を推し進める安倍晋三首相の政治的策謀と無関係ではないだろう。その年配の日川高校関係者は、山梨県立日川高校は安倍政権が推進する憲法改正の動きを先取りする学校であると言いたいようだ。

 日本国憲法改正論者の草分け

「憲法改正論者」として知られる安倍首相は、同じ自民党の先輩議員である広瀬久忠氏の著書『日本国憲法改正試案』(1957年発行)から多くの政治手法を学んできたと思われる。広瀬氏(第2代山梨県立日川高校同窓会長)は安倍首相と同じく、日本国憲法はアメリカによる「押しつけ憲法」であるとの認識をもっていた政治家であり、「天皇を中心とする神の国」再建の意志を明らかにした議員である。言い換えれば、戦後一党支配体制で日本の政界をリードしてきた自民党は、当初から日本国憲法改正を党の綱領として掲げてきたことになる。広瀬氏が『日本国憲法改正広瀬試案』を発表したのは1957年、その解説書とも言うべき『再建日本の憲法構想』の出版は1961年のことである。「広瀬試案」は、日本国憲法改正の主な理由として、「占領軍の指図」と「国情に合わない憲法」の二つをあげている。

憲法改正のためとして広瀬氏がここに述べている二つの理由には、日本が引き起こした戦時中の戦争犯罪に対する責任あるいは説明責任という視点が全く欠落していることがわかる。たとえ新憲法が日本の国情に合わないにしても、それが普遍的価値を与えられ、世界平和にとって有益なものであるかぎり、上記の二つの理由は結局利己的であるとの烙印を押されるだろう。また、「日本の国情」という概念も自民族中心の時代にそぐわない考え方で、戦前・戦中に教育を受けた人々の思想と言っていいだろう。以下、広瀬氏の「改正試案」の意図について検証してみたい。

日本国憲法改正のための広瀬試案

1 天皇の権能と地位

現行憲法 第1条 天皇条項
天皇は、日本國の象徴であり日本國民統合の象徴であって、その地位は、主権の存する日本國民の総意に基く。」(『Prime Minister of Japan and His Cabinet』ウェブサイト)

広瀬氏にとっての焦点は、天皇の権威の再生と日本軍の復活である。彼の目標を実現するためには、第一に天皇の地位や役割が明確化される必要がある。天皇の役割は「象徴」から「国民統合の中心」へ、また天皇の地位は「日本国の首位」(head of the State)へと変えなければならない。しかし広瀬氏は、「象徴の文字は日本の天皇の性格をはっきり表わすものではない」と説明する一方で、「head of the State」については「天皇主権再現の感を与える」との理由でこの言葉の使用にためらいを見せている。広瀬氏は、「head of the State」の訳として日本語の「首位(top)」を用いるが、私たちが英訳を読むかぎり、広瀬氏が「head of the State」に込めた隠れた意図を確定することはできない。

2 「憲法前文」の改変

もし日本国憲法から「象徴」の文字が消され、天皇が「日本国の首位(head of the State)」に改変されるならば、日本国憲法は必然的に旧(明治)憲法の様相を顕著に帯びるようになるだろう。日本国憲法の諸条項の中で「天皇の勅(詔勅)」に関する失効・排除の理由が明確に記述されているのは憲法の「前文」と憲法第98条であるが、「天皇の勅」を復権させる最も簡単な方法は現行憲法からこれらの条項を削除すればいいことになる。まず、現行憲法の「前文」から見てみよう。

日本国憲法前文①
「…この憲法は、かかる原理(国民主権・河西)に基くものである。われわれは、これに反する一切の憲法、法令及び詔勅を排除する。」(『教育六法』三省堂)

日本国憲法前文②
「日本国民は、恒久の平和を念願し、人間相互の関係を支配する崇高な理想を深く自覚するのであって、平和を愛する諸国民の公正と信義に信頼して、われらの安全と生存を保持しようと決意した。われらは、平和を維持し専制と隷従、圧迫と偏狭を地上から永遠に除去しようと努めてゐる国際社会において、名誉ある地位を占めたいと思ふ。」(『教育六法』三省堂)

広瀬氏は、とくにアジアの戦争犠牲者たちに深い哀悼の意を示したかに見えるこの「前文」の深い意味をくみ取ることのできるタイプの人ではなかった。彼の脳裏にあったのは彼が長く仕えた旧制度の復元であった。しかし皮肉なことに、彼が現在の「前文」から消去した語や文章の中には天皇の言葉も含まれていたのである。「平和を愛する諸国民の公正と信義に信頼し…」も「国際社会において、名誉ある地位を占めたいと思ふ」もまた消去されてしまった。

(1) 日本国民は、おおよそ一国の歴史と伝統が国の自主的な存立をささえ、かつ、その独自の発展力をつちかう基盤であって、国の固有の生命がすべてここを源として生成し、発展することを確信する。…ここに、外国軍隊の占領下に制定された日本国憲法を全面的に改正し、国家生活に関する規範を決定する
(2) 国民は、個人として尊重されなければならないとともに、また、国の一員としてのその国家的責務の遂行に努めなければならないことを宣明するものである。
(3) 日本国民は、世界平和を念願する。それ故に、平和の実現のためには各国が独自の発展を達成することが重要である。それこそ人類生存のための至上原理であると認める。よって、われらは、自国と同時に他国の主権とその尊厳を保持することに努めなければならず、相互の協調と調和こそ国際社会における指導精神とすべきことを宣言する。」(文献② 39頁~40頁)

3 天皇・防衛義務

「改正広瀬試案」第17条――天皇の権能
天皇は、内閣の決定に基いて、次の行為を行う。(①~⑨は省略)― 自衛力の発動に係る事態につき、国際法上の宣言を発すること」(文献① p.15

「日本国民は、国の安全を保ち、その独立を全うすることが、国家生活による福祉の完全な享有を確保する基本的な条件であることを確信し、この確信に立脚して、国民自らの福祉の防護のために、侵略に対する防衛を任務とする自衛軍を保持する。」(文献① p.93

「天皇の勅」の復活への試み

もし天皇の地位が「象徴」から「首位」に改定されるようなことが起るとしたら、多くの旧体制の遺物が再生するであろう。最も驚くべき復活の一つはすでに「最先端にいる日川高校」で起こっている。「神州第一の高校」の宣言である。このスローガンは近藤百之第16代校長(19661970)によって書かれたもので、詩の形式をとり、2001年に発行された「創立百周年記念誌」の中では学校の公式見解として記されている。

私たちにとって、近藤百之校長と広瀬久忠第2代同窓会長(19641971)の在任期間中に共通の理念が流れていると考えるのは驚くべきことではない。彼らの任期中に「神州第一の高校」の基礎がつくられ、その後継者たちによって校庭の前庭に校歌碑が建立されるのである。

「神州」や「天皇を中心とする神の国」といえば、4月に日川高校に入る生徒のすべては15歳にして洗脳の儀式に晒される。彼らは体育館の床の上に正座で座ることを命じられ、声がかれるまで「天皇の勅 勲立てむ時ぞ今」と歌い続ける。この慣習はしばしば軍国的であるとか時代錯誤であるとか批判されるが、今日でもこの種の“オリエンテーション”が山梨県内のこの高校では健在なのである。この種の教育環境で育った生徒たちは、意識するともなく天皇に対する親近感を抱くようになり、天皇に対する否定的な発言は「不敬」であると考えるだろう。2015829日の「ジャパン・タイムズ紙」次のような記事が掲載された。

「天皇裕仁は被害国に対し謝罪をしていない」(ジャパン・タイムズ)
   「東京は金曜日、中国国内における日本の戦争行為について天皇明仁の謝罪を求めるとした中国国営通信社の社説について北京に抗議書を送付した、と菅義偉(すがよしひで)官房長官は語った。…社説によると新華社は、没後昭和天皇と呼ばれる天皇裕仁は日本が始めた戦争の被害国に対し謝罪をしておらず、彼の息子の明仁が和解を進めるために謝罪し、遺憾の意を示すべきだ主張した。」(和訳・河西)

この社説に対し、岸田外務大臣はテレビで「不敬」という言葉をもって反論している。一方、菅官房長官も「天皇に対して極めて失礼である」との厳しい言葉でコメントし、「昨日、外交ルートを通じて中国に強く抗議した」と付け加えた(「ジャパン・タイムズ」2015/8/29)。これらの日本の指導者たちは、被害者たちから何が問われているのか理解しているのであろうか。これは「不敬」とか「失礼」という言葉で表現できる性質の問題ではない。日本サイドは、天皇を「head of the State」とか旧憲法下の「現人神」に近い存在であると見ていることは明らかであり、このことは戦後の国会が発した決議に反することにもなるだろう。衆議院による以下の決議は、我々が「天皇の勅」にどう対処すべきなのか説明している。

「詔勅を排除し、その指導原理を認めない」(「教育勅語等排除に関する決議」衆議院決議)
「…思うに、これらの詔勅の根本理念が主権在君並に神話的国体観に基いている事実は、明らかに基本的人権を損い、且つ国際信義に対して疑点を残すもととなる。よって憲法98条の本旨に従い、ここに衆議院は院議を以て、これらの詔勅を排除し、その指導原理を認めないことを宣言する。」(昭和23619日『解説教育六法』三省堂)

日川高校の校歌擁護派は、この国会決議も「アメリカ軍の指図」とでも言うのだろうか。衆議院決議は、「すでに過去の文書となっている天皇の勅が今もなお国民道徳の指導原理としての性格をもっているかのごとく誤解される」ことの理由について、「従来の行政上の措置が不十分であった」と指摘している。広瀬氏は、「広瀬試案」そのものが明らかにこの「衆・参両院決議」にも違反していることを理解していた。しかし、広瀬氏は「第98条は不必要」とさりげなく書くだけである。

「憲法が最高法規であることは云うまでもないことで、とくに一章を設けてまで明らかにする必要はあるまいと思う。先ず第98条をとり上げてみると、その1項は当然のことで、憲法に違反する法律命令等が効力のないことは勿論である。この規定(98条)は法律的には無意味であるばかりでなく日本国憲法としては、妥当性を書いていると思う。」(文献② 391~392頁)

母校校歌にノーと言った山本校長

この短いコラムを終わるに当たり、私は山本昌昭第23代日川高校校長(1985/4~1986/3)について触れなければならない。彼は長い日川高校の歴史のなかで、「天皇の勅もち 勲立てむ時ぞ今」の校歌に「ノー」と言ったただ一人の校長であった。彼は日本国憲法に違反する校歌について、関係者に広範な議論をすることの必要性を説いた。しかし、彼は匿名電話で何度も脅され、同窓会総会当日には、同窓会の有力者から肘で突かれている。議論を深めることができなかったことへの後悔と山本校長の母校への希望は、前述の『100周年記念誌』に記録されている。「戦争展」で「最先端にいる日川高校」と語った年配の日川高校関係者は、ぜひとも山本校長が記したページを読む必要があるだろう。彼ははっきりこう語っている。「『天皇の勅』はすべて失効し廃絶となっています」と。

The inside story of “The Nation of God with an Emperor at the Center” (3) The loophole in the Peace Constitution

 The national strategy for the preservation of the Imperial System

“The Nation of God with an Emperor at the Center” is full of taboos and inside stories. One of the many inside stories is Article 9 of the Japanese Constitution. This time I want to look into the “loophole” found in Article 9 of the Peace Constitution.

There has long been an insistence that a “loophole” has existed in Article 9 of the Peace Constitution, and that the idea of renunciation of war has been castrated. The dictionary says “loophole” means “a means or opportunity of evading a rule, law, etc.” In other words, a loophole can be used to exploit a poorly written law for unintended purposes, or it could have been intentionally built into the wording of the law by crafty legislators to be exploited later.

John W. Dower, an American historian, who wrote “Embracing Defeat” printed in 2000, makes use of the word “loophole”. He writes that the Japanese Constitution was made in May 1947, two years after the end of the war, and also adds that a clever “loophole” relating to the renunciation of war was included through the use of murky language introduced by Hitoshi Ashida (1948/3~1948/10, his tenure as prime minister) who chaired the sub-committee for the constitutional revision in the House of Representatives.

 “Under the circumstances of continued occupation, moreover, the issue of self-defense was hardly a pressing concern until June 1950, that is, when rearmament was initiated in the wake of the outbreak of war in Korea. Then the conservatives and the Americans alike found their loophole in the murky language of the Ashida amendment, and the opponents of remilitarization rallied around the ideals of disarmed neutrality that they believed to be firmly embedded in their “peace constitution”. Article 9 became the touchstone for a controversy that would wrack the body politic for decades to come.” (“Embracing Defeat” p.398) (Underlined by Kasai, the same hereafter)

JDower says, “Article 9 became the touchstone for a controversy that would wrack the body politic for decades to come”. This “touchstone” is still wracking the Japanese now 70 years after the end of the war. For the post-war Japanese, the idea of renunciation of war is believed to have saved them from the infamy of the label “Invader Japan” and provided mental support to war-torn Japanese who struggled to rise up on their own feet. Dower claimed that the person who introduced the “loophole” in the Peace Constitution was Hitoshi Ashida.

Where on earth was the “loophole” crafted in the “Ashida Amendment” of the Japanese Constitution? The “loophole” is not apparent to those who try to interpret the clause literally.

Aspiring sincerely to an international peace based on justice and order, the Japanese people forever renounce war as a sovereign right of the nation and the threat or use of force as a means of settling international disputes.
 In order to accomplish the aim of the preceding paragraph, land, sea, and air forces, as well as other war potential, will never be maintained. The right of belligerency of the state will not be recognized.” (“Embracing Defeat” p.395p.396)

 The “loophole” surrounding renunciation of war is said to be in the ambiguity of Article 9. Though war-renouncing Japan was reborn as a nation that “aspires sincerely to an international peace based on justice and order”, but, a logic is brought forth that the inherent right of self-defense is not ruled out even from a nation that renounced war. Dower explains that Ashida’s intention of creating the “loophole” was there from the start.

Ashida claimed that it had been his purpose from the outset to open the door to future amendment for self-defense.” (J.Dower)In subsequent years, the so-called Ashida amendment was used to argue that, in its final form, Article 9 did not prohibit rearmament for self-defense. The first paragraph, this argument went, established maintenance of international peace as the article’s objective; this being the case, the clause that now introduced the second paragraph (“In order to accomplish the aim of the preceding paragraph”) indicated that the “war potential” being renounced referred to maintaining a capability for aggressive war that would disrupt international peace. Ashida himself later claimed that it had been his purpose from the outset to open the door to future armament for self-defense through this change.”(“Embracing the Defeat”p.396)

For those who believed in Article 9 (the Ashida Amendment) that it meant a perfect war-renouncing clause, it seemed quite shocking to find the clause was engineered as a “loophole” from the outset. In that sense it is not too much to say that it was a maneuver that duped the Japanese and the people around the world. “The Japan times” where Ashida once worked carried an article as follows.

Japan is thus allowed to use force in self-defense.” (Hitoshi Ashida)
Ashida asserted that the phrase in question prohibits Japan only from using force as a means of settling international disputes. Japan is thus allowed to use force in self-defense and when participating in a U.N.-approved international military operation, he claimed.” (“The Japan Times”, Aug.18, 2014)

 Another sophistry used by “The Nation of God with an Emperor at the Center” (1928)

So far I have probed into some reading materials over the issue of self-defense related to the “Ashida amendment”. My overall impression is that the point appears to have been focused too much on whether or not Article 9 includes the right of self-defense, and the more important core issue over why the “loophole” was needed for Japan is rather trivialized. In order to understand how Japan has a history of sophistry, Mr. Dower illustrates a well-known instance called the “Kellogg-Briand Treaty”, which is said to have been a model for the Japanese constitution, and Article 9. By reading the following sentences, we are able to understand why and how Japan had found a “loophole” in the treaty of “Renunciation of War” formed in 1928.

It (the no-war ideal) reflected an international vision that had captured attention less than two decades earlier, before the world plunged into catastrophic war, in the form of the Kellogg-Briand Pact, or Pact of Paris, of 1928. Formally known as the General Treaty for the Renunciation of War, the Kellogg-Briand Pact provided the most obvious model for the renunciation-of-war language in GHQ’s draft.” (“Embracing Defeat” p.369)
“The General Treaty for the Renunciation of War” (Kellogg-Briand Treaty) was the international treaty formed after the end of the World War 1, and such major 15 countries as the United States, the Great Britain, Germany, France, and Japan ratified, and after that, 63 countries including the Soviet Union took part. Let’s take a look at the 1st clause of “The War-renouncing Treaty” joined by 90 % of the international countries (“No-war Treaty”, Wikipedia).

 In case a country that has the intention of locating a “loophole” in this war-renouncing treaty, what part of the clause does the country take notice? Let’s give it a try to take notice of the boldface. The reason this “war renouncing treaty” had not functioned fully was proved that there was a nation which found a “loophole” in the word “war”. Unfortunately the country that engineered such a trick was Japan, the “Nation of God with an Emperor at the Center”. In departing from the League of Nations, Emperor Showa issued the following Rescript.

 The wars fought by “The Nation of God with an Emperor at the Center” are all wars of self-defense

 We the Japanese must not forget the fact that Japan waged lots of wars of aggression pretending that they were wars of self-defense. We must remember that “The Nation of God with an Emperor at the Center” broke the War-Renouncing Pact ratified after World War 1 and invaded into Manchuria, claiming that it was an “incident” instead of “war”. Japan even had an infamous past designated by the international society as “rogue nations” together with Italy and Nazi-Germany. It was on April 17 in 1940 when Tripartite Pact was signed.

Then, what about Japan-US war? We have to bear in mind the fact that the Surprise Attack on Pearl Harbor on Dec,8, 1941 was also fought as a war of self-defense in order to set Japan free from the “economic and the military pressure” imposed by the United States. The then top leader, Emperor Showa, left us the explicit rescript, saying it was a war of self-defense.

But our adversaries, showing not the least spirit of conciliation, have unduly delayed a settlement; and in the meantime they have intensified the economic and political pressure to compel thereby Our Empire to submission. This trend of affairs, would, if left unchecked, not only nullify Our Empire’s efforts of many years for the sake of the stabilization of East Asia, but also endanger the very existence of Our nation. 「天皇を中心とする神の国」の秘話 ―(3)平和憲法(第9条)の「抜け穴」

天皇制護持のための国家戦略

「天皇を中心とする神の国」はタブーや秘話で満ちあふれている。たくさんある秘話の一つが日本国憲法第9条の問題である。今回は、「天皇を中心とする神の国」の秘話と題し、平和憲法(第9条)の「抜け穴」を使った国家戦略について検証する。

   憲法第9条には憲法制定当時から「抜け穴」が用意されており、戦争放棄の理念は骨抜きにされているという主張がある。「抜け穴」を辞書で引くと、「規則や法律などをのがれ出るための穴、あるいは機会」とある。つまり「抜け穴」とは、一つの不十分な語法の法律が意図せぬ目的のために利用されたり、あるいは、策略をめぐらす国会議員などによって後日意図的に法律用語に組み込まれたりすることをいうようだ。

「抜け穴」という言葉を用いているのは、『敗北を抱きしめて』を書いたアメリカの歴史家、ジョン・ダワーである。この歴史家は、敗戦から2年後の19475月に日本国憲法は成立したと書いた後、衆議院憲法改正小委員会委員長の芦田均(首相在任19483194810)は戦争放棄の曖昧な条項に巧妙な「抜け穴」を仕掛けたと付け加えている。

「占領が続いているという状況の下では、自衛の問題は差し迫った関心になることはほとんどなかった。― 1950年、朝鮮戦争の勃発を契機に再武装が開始された時までは。そしてその時保守派とアメリカは、芦田によるかすみのかかったようにわかりにくい修正文言のなかにあった抜け穴を見つけ、逆に軍事化に反対する者たちは『平和憲法』には非武装中立の理念がしっかりと埋めこまれていると確信し、この理念の下に結集した。第9条はその後何十年にもわたって国家を苦しめる論争の試金石となったのである。」(『敗北を抱きしめて』下186頁~187 岩波書店)(下線河西、以下同じ)

 ダワーは、「第9条はその後何十年にもわたって国家を苦しめる論争の試金石となった」と書いた。この「試金石」は、戦後70年目の現在においても日本人を苦しめているといっても過言ではない。戦後の日本人にとって、憲法9条の戦争放棄の理念は「侵略国家日本」の汚名から我々戦後世代を救い、敗戦の瓦礫の中から立ち上がろうとする日本人にとっての精神的な支えとなってきたのは確かである。その戦争放棄の憲法に「抜け穴」を仕掛けたのが芦田均だった、とダワーはいうのである。

憲法9条に仕掛けられた「抜け穴」

日本国憲法9条成立の際に加えられた「芦田修正」とは、いったいどこに仕掛けられたのであろうか。その「抜け穴」は、条項を字義通りに解釈しようとする人には見えにくい構造をもっている。

戦争放棄の「抜け穴」は、憲法9条の「平和の理念」の曖昧さにあると言われている。戦争を放棄した日本は「正義と秩序を基調とする国際平和」を誠実に希求する国として生まれ変わったが、一国が本来もつ自衛する権利は「戦争を放棄した国」からさえも排除されないとする論理である。ダワーによれば、「芦田修正」によるこの「抜け穴」は当初から意図されたものであったという。

「…その後、このいわゆる芦田修正は、第9条がその最終的な形において自衛のための再武装を禁止していないという議論の根拠となった。その主張によると、第1項は9条の目的としての国際平和の維持を謳ったものであるが、その場合、第2項の導入句(「前項の目的を達するために」)により、国際平和を妨害する侵略戦争のための能力が放棄されるべき『戦力』となる。芦田自身のちに、この変更によって自衛のための武装へと道を開くことが、当初からの目的であったと主張している。」(『敗北を抱きしめて』下182 岩波書店)

平和を希求する第9条(芦田修正)には当初から「抜け穴」が仕掛けられていたとする記述は、完全戦争放棄の理念を信じていた人々にとっては衝撃的であったと思われる。その意味では、日本国憲法に埋め込まれた「芦田修正」は平和を求める日本国民や世界の諸国民を欺く策謀だと言わなければならない。芦田がかつて勤務したことのあるジャパン・タイムズ紙は、次のような記事を載せている。

「日本は自衛力の使用を許されている」(芦田均)
「芦田は、問題の文言(第9条)は日本が国際紛争を解決する手段としてのみ武力を使うことを禁じていると主張。かくして日本は、自衛の場合と国連が認可した国際的軍事行動に参加する際の軍事力行使は許されていると、主張した。」(『ジャパン・タイムズ』2014818)(訳・河西)

  これまで見てきた「芦田修正」に関する資料は、焦点があまりに戦争放棄を定めた憲法9条と自衛権の関係にしぼられている感があり、「なぜ日本には『抜け道』が必要だったのか」という本質的な問題が矮小化されているという印象は否めない。日本が過去においていかなる詭弁を弄したかについて、ダワーは、憲法9条のモデルとなった「戦争放棄の条約」(ケロッグ=ブリアン条約)との関係について触れている。下記の文章を読むことで、私たちは、なぜ、どのようにして日本が1928年に成立した「戦争放棄」の条約に「抜け穴」を見つけ、これを破棄したのかについて理解することができるだろう。

『戦争抛棄に関する条約』(ケロッグ=ブリアン条約)は第一次世界大戦後につくられた国際条約で、1928年にアメリカ、イギリス、ドイツ、フランス、イタリア、日本といった当時の列強諸国をはじめとする15か国が署名し、その後、ソビエト連邦など63か国の参加をみている。当時の世界の国々の9割以上が署名した(『不戦条約』ウィキペディア)という条約の第1条を見てみよう。

もしこの不戦条約に「抜け穴」を見つけようとする意図をもつ国があるとするなら、どの部分に着目するであろうか。太字にした「戦争」という単語に注目してみよう。この不戦条約が機能を十分に果たすことができなかった理由は、「戦争」という語に「抜け穴」を見つけた国があったからである。残念なことながら、そのような策略をめぐらす国が「天皇を中心とする神の国」だったのだ。国際連盟離脱にあたり、昭和天皇は次のような「勅」を発している。

「天皇を中心とする神の国」の戦争はすべて自衛の戦争

私たち日本人は、日本がかつて平和や自衛と称して多くの侵略戦争を行なった事実を忘れてはならない。「天皇を中心とする神の国」は第一次世界大戦後に成立した「戦争放棄」の条約を破り、“戦争”ではなく“事変”と称して満州を侵略したことを記憶しなければならない。日本には、イタリアやナチス・ドイツとともに、国際社会から「ならず者国家」と名指しされた過去があるのだ。日独伊三国同盟が結ばれたのは1940417日のことである。

それでは日米戦争はどうか。日本軍は1941128日に真珠湾奇襲攻撃を仕掛けたが、この先制攻撃も、アメリカの「経済上・軍事上の脅威」に対する日本軍の自衛戦争の一部として行なわれたという事実を記憶しなければならない。昭和天皇は、真珠湾奇襲攻撃は自衛戦争であるとの認識を「開戦の詔書」の中で明らかにしている。
